PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: An Amendment to the Plat of Cooperton
Townsite, Block 12.
APPLICANT: Charles Moore
LOCATION: Lots 1, 2, 3, 4, 5, and B, Block 12 of the
Cooperton Townsite.
SITE DATA: Currently there are six (6) individual lots
That are 25' x 160' each more or less in
size.
WATER: Sutank Water Association
SEWER: ISDS
ACCESS: Sopris Avenue
EXISTING/ADJACENT ZONING: R/L/UD
I. RELATIONSHIP TO COMPREHENSIVE PLAN
The site for the amended lots is designated by the Garfield County
Comprehensive Plan of 2001, Proposed Land Use District Maps as High
Density Residential (less than 2 acres per dwelling unit). The amendment
request appears to be consistent with the proposed designations.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located within the Townsite of Cooperton,
Block Number 12, and is accessed off of Sopris Avenue.
B. Project Description: This portion of Block 12 is currently platted as five
(5) individual lots. The request is to amend the plat for lot numbers 1-5
and lot B to be redrawn as one (1) parcel. The new parcel will be
approximately 0.50 acre in size more or less.
III. MAJOR ISSUES AND CONCERNS
A. Subdivision Regulations: Section 6:10 of the Garfield County Subdivision
Regulations establishes the criteria for an amended plat. An amendment
can be made to a recorded plat, if such amendment does not increase the
number of subdivision lots or dwelling units, results in a major relocation
of a road or add new roads. The BOCC shall consider the amended plat
request at this meeting. The applicant will be responsible for mailing the
notices and shall present proof of mailing at the meeting.
B. Zoning: The proposal meets the criteria of a minimum lot area of seven
thousand five hundred (7,500) square feet lot size as required by the
R/L/UD zone district.
C. Legal Access: Access will be provided off of Sopris Avenue.
D. Water and Sewer: the Sutank Water Association will provide the water
and sewage will be handled by an ISDS. The ISDS will have to meet the
County ISDS regulations for separation from wells and other ISDS in the
area.
E. State and Local Health Standards: No State or local health standards are
applicable to the application, with the exception of Colorado Department
of Health ISDS setback standards.
F. Easements: Any required easements (drainage, access, utilities, etc.) will
be required to be shown on the amended plat.
G. Fire Protection: The property located in Block 12 of the Cooperton
Townsite, is located in the Carbondale Rural Fire Protection District.
They currently provide fire protection service to the property and will
continue to do so.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as required for
the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and issues
were submitted and that all interested parties were heard at that
meeting.
3. That for the above stated and other reasons, the proposed
amendment is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
Staff recommends APPROVAL, with the following conditions of approval:

1. That all representation of the applicant, either within the application or
stated at the meeting before the Board of County Commissioners, shall
be considered conditions of approval.
2. An Amended Plat, Cooperton Townsite, Block Number 12 shall be
submitted, indicating the legal description of the parcel, dimension and
area of the lot, access to a public right-of-way, and any proposed
easements for setbacks, drainage, irrigation, access or utilities.
