BACKGROUND The applicants are requesting that four small lots of the original Townsite of Cooperton be consolidated into one. II. REQUEST The application is for an Amended & Corrected Plat, RLUD zone district. III. AUTHORITY Section 9.03.04 of the Zoning Resolution of 1978, as amended, requires that Amended & Corrected Plats applications (more than 2 lots) be initially brought to the Board so that the Board may determine if a recommendation from the Planning Commission is necessary. IV. STAFF RECOMMENDATION: Staff finds that because this application proposes no new lots and has limited complexity, it is appropriate to recommend that the Board direct Staff to schedule a public hearing for the Board, and NOT refer the matter to the Planning Commission. REQUEST The applicants are requesting that four small lots of the original Townsite of Cooperton be consolidated into one large lot. gusr II. REVIEW STANDARDS Section 6.10 (3) of the Zoning Resolution of 1978, as amended, requires: The Board shall not approve an amended plat unless the applicant has satisfied the following, criteria: A. All Garfield County zoning requirements \eill be met: B. All lots created will have legal access to a public right-of-way and any necessary access easements have been obtained or are in the process of being obtained: C. Provision has been inacle for an adequate source of water in terms of both the legal and physical quality. quantity and dependability.. and a suitable type of sewage disposal to serve each proposed lot: D. A11 state and local environmental health and safety requirements have been fillet or are in the process of being met: E. Provision has been made for any required road or storm drainage improvements: F. Fire protection has been approved by the appropriate fire district: CT. Any necessary drainage, irrigation or utility easements have been obtained or are in the process of being obtained: and H. School fees, taxes and special assessments have been paid. STAFF FINDINGS: A. The proposal does not create lots, add any roads or propose any road relocation. B. Legal access to a public right-of-way exists and will be continued. C. Provision has been made for an adequate source of water for both culinary purposes and irrigation to serve the lot. (As part of the purchase agreement with Charles Moore, the applicants have a culinary tap with the Sutank Water District, and 4 shares of irrigation water with the Rockford Ditch Water Association. The tap and shares must be transferred to the applicant's ownership prior to the recording of the plat.) Any ISDS system installed must be adequately separated from water systems. D. All state and local environmental health and safety regulations have been met or shall be met. E. Stormwater is accommodated on the lots now. There are existing open ditches on the property. These lots are in an area outside of those requiring Traffic Impact Fees. There is an existing driveway onto the property, but no structure. F. No comments about fire protection issues were presented by the fire service provider. There is an existing fire hydrant in the utility corridor along Cedar Street in front of what is the Lot 7 frontage, within 160 feet of any point on the property. G. There are existing fencelines, ditches and mention of a vacated alley on the survey presented. These existing fencelines do not constitute boundaries, nor appear depicted in easements. It was suggested to the applicant that placing the fences on the lot boundaries at this time might prevent disputes in the future. H. There are no special assessments in this area, and school fees and taxes have been satisfied. This proposal can satisfy the requirements set forth in 6.10 (3). Perry Amended and Corrected Plat — BOCC — 7/7/08 Page 3 IV STAFF RECOMMENDATION Staff is in support of this amendment. Planning Staff therefore recommends that the Board of County Commissioners approve this amended plat request with the following conditions. 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. As part of the purchase agreement with Charles Moore, the applicants have a culinary tap with the Sutank Water District, and 4 shares of irrigation water with the Rockford Ditch Water Association. The tap and shares must be transferred to the appliant's ownership prior to the recording of the plat. 3. Any ISDS system installed must be adequately separated from water systems. 4. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in §5:22 of the Garfield County Subdivision Regulations.
