PETITION TO THE BOARD OF COUNTY COMMISSIONERS COUNTY OF GARFIELD AND STATE OF COLORADO Re: Vacation of some streets and alleys within the Townsite of Cooperton,-Garfield County We, the undersigned persons, are owners of the property described in the column set forth opposite our respective names and we do hereby request the Coirluhissioners of Garfield County to vacate those portions of the streets and alleys in the Townsite of Cooperton which are shaded in black on the attached Exhibit Our reasons for requesting this action by you are as follows: 1. The owners of lots have been occupying the adjacent streets and alleys shaded on the map in black for as long as anybody in Cooperton can remember. This occupation consists of fences and in some instances other improvements such as houses and outbuildings. 2. Those portions of the streets and alleys shaded in black have not been used by the public as streets and alleys and have not been maintained by the County within our memory. 3. None of us feel that streets and alleys shaded in black ever need to be opened for future plans that we have. If we receive a preliminary indication from the County Commissioners, that the vacation could be accomplished, then we would propose to have a licensed surveyor prepare a legal des- cription of what property we wish to have vacated and we would be willing to enter into agreements with the suppliers of elec- trical and telephone utility services to the community so that • • none of the utilities were left without a right-of-way as a result of the vacation of a street or alley where they might be located. This would apply to other utility services as well which might come in in the future. The surveyor, as part of his work, would establish at sev- eral points throughout the townsite permanent monuments which would be of great assistance to -all future property owners in as- certaining the exact location of their lots and their portions of the vacated streets and alleys in the event the Commissioners do vacate the streets and alleys. We have had several meetings already in consideration of this and we have appointed a committee of our residence who have worked on the matter so far. The members of this committee are Jim Springsteel, Chairman, Walter Roberts, Ken Elliott, Robert Dowding, and Wendell Coats. These people have talked with the property owners and have prepared this Petition and Exhibit and made some progress on a proposal to raise the money to pay the costs of this matter. The biggest cost, of course, is the surveyor's fee. Exhibit A, attached hereto is a tentative sketch of a proposed plan of vacation which we think is appropriate. Our committee stands ready to answer any questions and provide any assistance to the Commissioners that they can. Thank you for the consideration of this matter.
