RESOLUTION NO. 79-112

WHEREAS, Four Mile Ranch Company, a Partnership,
being the owners of all of the following real property
situate in the County of Garfield, State of Colorado, to -wit:
and;
A parcel of land situated in Section 27,
Township 6 South, Range 89 West of the Sixth
Principal Meridian, Garfield County, Colorado;
said parcel created by subdivision of a
boundary plat of portions of said Section 27
and of Section 34, said Township and Range,
dated May 23, 1973, and revised August 8, 1978,
and signed and sealed by Jack W. Johnson, Colo-
rado R.L.S. 44551; said parcel being more par-
ticularly described as follows:
Commencing at the South Quarter Corner of
said Section 27, thence N. 39°11'02" E. more
or less 1695.95 feet more or less to the True
Point of Beginning; thence S. 88°24'24" E. more
or less 291.37 feet more or less; thence S.
01°29'11"W. more or less 750.30 feet more or
less; thence N. 88°24'24"W. more or less 290.80
feet more or less; then N. 01°26'34"E. more or
less 750.30 feet more or less to the True Point
of Beginning; containing 5.0 acres more or less.
WHEREAS, said owners made application to The Board of
County Commissioners of Garfield County, Colorado for a zone
district amendment changing the zone district designation for
all of Said property from A/R/RD-Agricultural/Residential/
Rural Density to C/G - Commercial/General; and
WHEREAS, The Board of County Commissioners of Garfield
County, Colorado has in accordance with the requirements of
Section 10.04 of the Garfield County Zoning Resolution referred
said application to the Planning Commission for its consideration
and recommendation and;
WHEREAS, The Planning Commission upon consideration of
said application has recommended that the zone district amend-
ment be approved upon the condition that the owner grant an
easement thirty feet wide from the centerline for public road
and utilities, and the Planning Commission has accordingly

forwarded to the Board of County Commissioners its recom-
mendation that said application be granted; and
WHEREAS, The Board of County Commissioners has con-
sidered said application and the recommendation of the Planning
Commission and held an advertised public hearing on the 4th
day of September, 1979, on said application all in accordance
with the provisions of Section 10.00 of said Garfield County .
Zoning Resolution, and;
WHEREAS, The Board of County Commissioners has determined
on the basis of the evidence presented at said hearing that
the requested rezoning request would be consistent with the
Garfield County General Plan, with the orderly development
of the County, and with existing uses in the area, if the
condition recommended by the Planning Commission is made a
prerequisite to the effectiveness of the zone district amend-
ment;
t•.IIE{'.EAS, the requested zone district amendment would
be consistent with the General Plan for Garfield County,
Colorado;
NOW THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado that the zone district
designation of all of the above described real property be and
the sante shall be changed from A/R/RD - Agricultural/Residen-
tial/Rural Density to C/G - Commercial/General upon the pre-
sentation to the County, within thirty days of the adoption of
this Resolution, of a deed from the owners of the property
of a right-of-way for road and utility purposes sixty feet wide
extending along the entire east boundary of the described
property, upon which presentation and acceptance by the County
'such amendment shall be entered on the appropriate sheet of
the Zone District ivIap of Garfield County in accordance with the
provisions of Section 10.04.02 of the Garfield County Zoning
Resolution.

Commissioners of Garfield County, Colorado hereby certifies
that the within and foregoing Resolution was unanimously
adopted at a regular meeting of the Board of County Commis-
