RESOLUTION NO. 83-155
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION'REGULATIONS FOR L.W. AND SANDRA WRIGHT AND'THE LAZIER -SILLS
PARTNERSHIP.
WHEREAS, L.W. and Sandra Wright and the Laziei:-Sills Partnership have
petitioned the Board of County Commissioners of Garfield County, Colorado,;
for an exemption from the definition of the terms "subdivision" and
"subdivided land" under C.R.S. 1973, 30-28-101(10) (a) -(d)., as amended, and
the Subdivision Regulations of Garfield County, Colorado. adopted January
2, 1979, Sections 2.02.21 (d) and 3.02001 for the purpose of a boundr;-ry
line adjustment for those parcels of land described in Book 564 and Pages_
249-51 and Bok 583 and Pages 749-52-, as filed in the Office of the Clerk
and Recorder of Garfield:County, Colorado. The above described boundaries
are hereby amended and lore particularly described as follows:
TRACT A: A parcel of land situated in the SW 1/4 SW 1/4 and the SE L1/4 SW
1/4. of Section 25 and in the N1/2 NW 1/4 of Section 36, Township
5 South, Range 90 West of the 6th Principal Meridian, according
to the original survey or:,file in the Surveyor'General's Office
in Denver, Colorado, dated February 13, 1884, Said Parcel of
land being more particularly described as follows:
BEGINNING at the Northwest Corner of.said Section 36, a 1" x 8" x
6" Red Sandstone found in place, THENCE South 85°33'48":East,
1373.32 feet to a-rebar and cap in p'±aces being the TRUE POINT OF
BEGINNING; THENCE North 00°36'16" West, 92.85 feet; THENCE North
10°45'32" East, 104.12 feet; THENCE 12°54'49" East, 195.09 feet;
THENCE North 01°30'05" West, 174.98 feet; THENCE North 10°59'32"
West, 351.50 feet; THENCE North 00°36'16" West, 40.56feet;
THENCE South 78°10'50"West, 187.57 feet to the centerline of
Canyon Creek; THENCE ALONG SAID CENTERLINE THE FOLLOW:.NG
BETARINGS AND DISTANCES: South 09°18'05" East, 22.85 feet; South
04°08'06' West, 424.03 feet, South 23°38'42" West, 18'0.64 feet;

230.07 feet to the TRUE POINT OF BEGINNING containing 5.71 acres
more or less.
TRACT B: A parcel of land located in the Southeast 1/4 of the Southwest
1/4 of Section 25, Township 5 South, Range 90 West of the Sixth
Principal Meridian and in the Northeast 1/4 of the Northwest. 1/4
of Section 36, Township 5 South, Range 90 West of the Sixth
Principal Meridian, said parcel being more particularly described.
as follows:
Beginning at the'South One-Qu?rter corner of said Section 25, a
brass cap set in place by the Garfield County Surveyor in 1954;
Thence South 08°17'28" East, 748.11 feet to the North boundary
line of the River View Subdivision the following courses: North
85°33'17" West, 2.18 feet; South 82°07'03"West, 44.85 feet;
South 59 59'00"West, 73.43 feet; South 01°01'00"West, 339.22 feet
to a point on the South right-of-way line of Old County Road as
best evidenced by a fenceline existing at the time of the survey;

West, 139.43 feet; South 57°47'57 West, 18.57 feet to the.
Nor*,east corner of a parcel of land described in Book 354 at
Page 119 of the Garfield County Records Office: Thence.South
57°34'00" West, 119.85 feet along the North boundary as described
in said Book and Page to the centerline of Canyon Creek; Thence
along the centerline of Canyon Creek the following courses:
North 13°58'28" West, 286.76 feet; North 13°19'13" East, 256.93
feet; North 08°00117 West, 233,05 feet; North 14°09'31" East,
279.69 feet; North 01°22'52" East, 162.17 feet; North 20°47'54
West, 92.26 feet; Thence leaving said Creek centerline, along the
south boundary line of a parcel of land described in Book 563 at
Page 586 'of the Garfield County Records Office South 86°31'08
East, 230.07 feet; Thence•along the East boundary line of said,
parcel North 00°36'16" East, 92.85 feet to a point; Thence North
10°45'32" East, 104.12 feet to a point; Thence North 12°54'49"
East, 195.09 feet to a point; Thence North 01°30'05" West, 174.98
feet; Thence North 10°59'32" West 351.50 feet to a point on the
East boundary line as described in said Book and Page; Thence
North 00°36'16" West, 40.56 feet along said East boundary line;
Thence leaving said East boundary line on a bearing of North
78°10'50" East, 49.56 feet to a point; Thence North 01°05'39
West, 460.06 feet to a point on the North line of said Southeast
1/4 of the Southwest 1/4 of Section 25; Thence North
89°24'49"East, 1196.97 feet along said North section line to the
North-South centerline of said Section 25; Thence South 01°02'25"
West along said centerline 1310.33 feet to the South 1/4 corner
of said Section 25 being the Point of Beginning containing 74.577
acres, more or less.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that the
proposed division does not fall within the purposes of Part 1, Article 28,
Title 30, Colorado Revised Statutes 1973, as amended, for the reason that
the boundary line adjustment will not create any new lots of record., and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said
tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the'Colorado Department of
Health, and the boundary line adjustment does not fall within the general
purposes and intent of the subdivision regulations of the State of
Colorado and the County of Garfield, and should, therefore,..be exempted
from the'definition of the terms "subdivision" and "subdivided land" as
set forth in C.R.S. 3973, 30-28-101 (10) (a) -(d), as amended; •
NOW, THEREFORE, BE IT RESOLVED that the boundary line adjustment .of
the above described tracts "A" & "B" is hereby exempted from such
definitions and said tracts may be adjusted into tracts "A" & "B", all as
is more fully described above, and said adjustment may be conveyed in the
form necessary without further compliance with the aforesaid subdivision
statutes and regulations; and that a copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
