Re: Administrative Review of Minor Subdivision — Eastbank, LLC: MISA 8259
High Country Engineering, Inc. (HCE) has received your emailed comments dated July 29, 2015
for the Minor Subdivision Application for Eastbank LLC. A point by point response to your
email comments is located below. Your comments have are italicized and the HCE response is
below the comment in bold text.
COMMENTS AND CORRECTIONS
In order for the Community Development Department to approve the resubmitted plans for
Eastbank LLC, the following issues need to be addressed.
MINOR SUBDIVISION APPLICATION PLANS, MISA-8259, SHALL INCLUDE:
1. The Applicant has 90 days within which to .satisfy conditions of approval and provide the
following documentation. for BOCC signature and recordation:
a. A plat mylar with signed Certificates that include Dedication and Ownership,
Title. /axes, Surveyor, and any mortgages;
• Acknowledged.
b. The names and addresses for the .surface properly owner and mineral estate shall
be updated on the plat;
• Acknowledged and added.
c. Recording Fees.
• Will be paid immediately on request.
2. Prior to BOCC signature on the Plat, the Applicant shall provide a valid argumentation
plan and well permit _fir Lot 1. These documents shall he accepted by the Division of
Water Resources. The accepted documents shall be reviewed by the Garfield County
Community Development Department.

• Provided by Garfield & Hecht and acknowledged complete by
David Pesnichak on 7/29/15.
3. Prior to BOCC signature on the Plat, the Applicant shall provide a valid argumentation
plan and well permit for Lot 3. 'These documents shall be accepted by the Division of
Water Resources. The accepted documents shall be reviewed by the Garfield County
Community Development Department.

David Pesnichak on 8/3/15.
Prior to BOCC signature on the Plat, the Applicant shall conduct a water quality test on
the well to serve Lot 3. Me results of the wafer quality analysis shall comply with Section
4-203(M)(1)(b)(5)(b)of the LDDC. The results of the water quality analysis shall be
reviewed by the Garfield County Community Development Department and designated
County Engineer.
• Test completed with lab results to be delivered to David
Pesnichak.
5. Prior to BOCC signature on the Plat, the Applicant shall conduct a 4 -hour pump test on
the well to serve Lot 3. The results of the pump test shall comply with Section 4-
203(M)(1)(b)(5)(h)of the 1. UDC. The results of the pump test shall be reviewed by the
Garfield Comity Community Development Department and designates/ ('olinty Engineer.
• Test completed with lab results to be delivered to David
Pesnichak.
Prior to BOCC signature on the Plat, the Applicant shall conduct a water quality test for
coliform on Lot 2. The results shall be reviewed by the Garfield County Community
Development Department and designated County Engineer.
• Test completed with lab results to be delivered to David
Pesnichak.
7. Prior to BOCC signature on the Plat, the Applicant shall execute and record a Driveway
Sharing Agreement(s) which addresses ongoing long-term maintenance of the access
road across Lot 2 to Lot 3 and across Lot 1 to Lot 2. A draft Driveway Sharing
Agreement(s) shall be submitted for initial review and comment by the County
Community Development Department and Attorneys Office. The final agreed upon
documents shall be recorded prior to BOCC signature on the plat.
• Provided by Balcomb & Green and acknowledged approved by
David Pesnichak on 8/13/15. The recording requirement is
acknowledged.
8. Prior to BOCC signature on the Plat, the Applicant shall address the use of Stormvater
Management BMPsfor the existing uses on Lot 2. Should issues in stormwater drainage
from the existing uses on Lot 2 be identified, the issues shall he remedied to the
satisfaction of the Garfield County. Contract Engineer. The analysis shall he reviewed by
the Garfield County Contract Engineer and the Community Development Department.

• Gould Construction manages stormwater via state stormwater
management plan and permit #COR030000, which is currently active.
Intermountain Waste to our knowledge is not required to have a
stormwater management permit and we are proposing a couple
BMP's (sediment control fence and erosion logs) to address some
stormwater concerns identified with the county's contract engineer.
9. Prior to the BOCC signature on the Plat, the Applicant shall add the following plat notes
and make the. following alterations to the plat:
a. Add the following plat note: The property is underlain by Eagle Valley Evaporite,
and numerous sinkholes and soil -collapse occurrences have been identified within
several thousand feet c f the site. Sinkholes, subsidence and ground deformation
due to collapse of solution cavities and voids are a serious concern in the Eagle
Valley Evaporite. Infrequent sinkhole, formation is still an active geologic process
in the Roaring Fork Valley, and ground subsidence related to the dissohlion of
evaporate bedrock is an unpredictable risk.
• Acknowledged and added.
b. Add the following plat note: The access driveway from CR 154 to Lot 1 of the
Eastbank Minor Subdivision may only he combined with access to Lot 2 of the
Eastbank Minor Subdivision. The access driveway from ('R 154 to Lot 1 shall not
be combined with the acce.s.\ to any other parcel or lot.
• Acknowledged and it should be noted that the easement identified
on the plat to the school district at that location would only provide
ROW clearance for the extension of CR 154 to the school site and the
closure of the current CR 154 access to highway 82.
c. Add the following plat note: Lot 2 and 3 shall develop a storm water management
plan al the lime t f development or redevelopment.
• Acknowledged and added.
d. Add the name and address of the surface owner of the subject parcel as required
in Section 5-402(F)(1).
• Acknowledged and added.
e. Add the address of the Surveyor, Frank Harrington, as required in Section 5-
402(1) (2).
• Signature for the Professional Land Surveyor signing the plat has
been added.
f. The. final Mylar shall he prepared only in greyscale.
• Acknowledged.
10. All representations of the Applicant within the application shall be considered conditions
of approval unless otherwise modified by the Director.

11. No further subdivision of these parcels is permitted by Minor Subdivision.
• Acknowledged.
12. The Applicant shall treat the Scotch thistle and Russian -Olive identified on the property
in the Wildlife and Ecological Assessment by October 31, 2015. The Applicant shall
provide records to the Vegetation Management Department as evidence that these
County listed noxious weeds have been managed.
• Acknowledged and See Planner's response.
We believe that the comments have been addressed and completed to the best of our knowledge
and it is not anticipated that there will be further comments. Please let us know if you need any
