I represent Dean Bramlet with regard to his request for variance for property located a 57
Corral Drive, Carbondale, CO 81623. As part of my work on the variance application, I have
reviewed a Title Commitment for the Bramlet property prepared by Commonwealth Title Company
(File No. 1508040). Base upon my review of the title documents described in the Title
Commitment, I have concluded that the mineral rights associated with the Bramlet property have
not been severed into private ownership.
In addition to reviewing title documents related to the Bramlet property, I have searched the
on-line database of the Garfield County Assessor's Office for all separately taxed property interests
in Section 31, Township 7S, Range 87W. In my review, I did not find any separately taxed mineral
interests in that Section. Additionally, the Title Commitment did not identify any notices filed with
the Garfield County Clerk and Recorder of severed mineral estate owners requesting notice
pursuant to C.R.S. § 24-65.5-103.
After reviewing title and County documents related to the Bramlet property, I conclude that
the mineral rights have not been severed and that there are no mineral estate owners who are
entitled to notice under the County Code or State Statute.
