TYPE OF APPLICATION: Variance
I. GENERAL PROJECT DESCRIPTION
Applicant own a home constructed in 2000 on Lot C14 of the Aspen Equestrian Estates
Subdivision, Preshana Farm PUD which is located near the southwest corner of the
intersection of SH 82 and CR 100.
Building permit 7912 was issued in 1999 and lists the side setbacks as 10' rather than the
15' required by the PUD. A recent ILC indicates that the home encroaches into the
required 15' side yard setback by 11". The Owner would like to remedy this error and
obtain a variance from the side yard setback.
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
Garfield County Land Use and Development Code, as amended (LUDC) - Sections:
1-101 — Common Review Procedures
4-115 — Variance
C. Review Criteria.
The following standards shall be satisfied for approval of a request for variance from specific
regulatory provisions of this Code:
1. Special Circumstances or Conditions Exist. One or more of the following
circumstances or conditions exist with respect to the specific property:
a. Exceptional narrowness, shallowness, or shape of the property at the
time of the enactment of the regulation in question;
b. Exceptional topographic conditions of the property; and
c. Other extraordinary and exceptional situations or conditions of the
property.
4-201/4-203 Submittal Requirements and Description of Submittal Requirements
The process to accommodate these requests shall require a Land Use Change Permit for a
Variance process pursuant to the LUDC.
A. Pre -application Conference.
B. Application Submittal. 3 paper copies and 1 electronic copy
C. Determination of Completeness.
D. Schedule Public Hearing, provide documentation regarding notice
requirements.
E. Additional Copies requested for decision makers.
F. Evaluation by Director/Staff resulting in a Staff Report to the Board of
Adjustment.
G. Public Hearing before the Board of Adjustment, resulting in a decision of
approval, approval with conditions or denial.
H. Resolution formalizing the decision.
I. Satisfaction of any conditions of approval and issuance of a Land Use
Change Permit.

Public Hearing notices shall be posted, mailed and published pursuant to Section 4-101.E.
for a public hearing before the Board of Adjustment.

V. SUBMITTAL REQUIREMENTS
1. General application materials
o Detailed project description
o Application form and fee
o Agreement to pay form
o Copy of Deed or Title Commitment as proof of ownership
o Names and mailing addresses of mineral owners of the subject property
o Names and mailing addresses of all owners of property within 200' of the subject
property
o Assessor map indicating location of the above properties
o Copies of building and septic permits (existing)
o Copy of this pre -application form
2. Site Plan (4-203D); (ILC will suffice)
3. Statement of request and response to standards in Article 7.
Applicant may request waiver of specific submittal requirements upon demonstration compliant with
Section 4-202 of the LUDC.
VI. APPLICATION REVI .
This application will be subject to the following fees and deposit requirements:
Planning Review Fees: $ 250.00 Plus additional Staff time at staff hourly rate of $40.50
Referral Agency Fees: $ TBD
Total Deposit: $ 250.00
General Application Processing
Planner reviews case for completeness and sends to referral agencies for comments. Case planner
contacts applicant and sets up a site visit. Staff reviews application to determine if it meets
standards of review. Case planner makes a recommendation of approval, approval with conditions,
or denial to the appropriate hearing body.
