Dear Mr. Nelson;
Garfield County Community Development is in receipt of the above referenced
application to amend an existing Land Use Change Permit for a temporary facility which
expired on May 7, 2014. This application was submitted on May 6, 2014 but was not
accepted for further review until May 19, 2014 when payment of the application fee was
submitted. Pursuant to Section 4-101 B. (1.)(a.) a period of ten (10) business days is
provided for the County to determine if the application materials are complete.
The submittal has been reviewed and the following items have been found deficient:
1. The application form is incorrect. Please submit a revised application amending
the following items:
a. The Type of Application (on top of page 1) is an "Amendment to an
Approved LUCP" "LIR".
b. The property owner name is incorrect; please change the Applicant to "Ski
Sunlight Inc-"
c. According to the Assessor's records Parcel Number 2395-333-00-051 is a
183.17 -acre parcel. This needs to be corrected on the application form as
the subject site acreage.
2. Information must be submitted regarding the legal ability of Commnet to apply
for this land use on land owned by a corporate entity. This legal requirement is
satisfied with submittal of a recorded Statement of Authority for Ski Sunlight Inc.
Research in the Clerk's records found a Statement of Authority for Sunlight, Inc.
however this is a different corporate name and therefore will not satisfy the need
for a Statement of Authority for Ski Sunlight, Inc.
3. Submittal of a deed is to demonstrate ownership is required. A Deed of Trust
relates to the mortgage on the property and therefore does not demonstrate
ownership.
4. An Amendment to a Land Use Change Permit is required to demonstrate that a
Land Use Change Permit exists. Please provide a copy of the Resolution and
Permit that approved a Communication Facility to exist on the site. This
documentation is recorded and therefore available at the Garfield County Clerk's
Office.
5. Resolution 2012-41 contains condition of approval #4 that needs to be complied
with again. The email dated April 30 (under tab H) states that the FCC
completion of the NEPA work will be 7/15/14. Please provide evidence of
compliance with this FCC requirement (i.e. a copy of submittal work to the FCC).
6. A copy of the Pre -application Summary Form prepared by Dave Pesnichak is a
submittal requirement and therefore must be included in the application
materials.
Please correct these deficiencies and provide one revised copy of the application for
further review. The LUDC provides the Applicant 60 -days to remedy the issues, if
technical completeness is not achieved within 60 -days of this letter the application will
be withdrawn.
