Applicants are required to indicate appropriately and to submit completed checklist at time of application for a permit: 1. SGM has completed the design for the septic systems for the maintenance and office buildings at the Sievers Pit site. This design is based upon percolation data collected by SGM through percolation testing during the week of April. 19. The results of those percolation tests indicated that the proposed disposal fields for both the office building and maintenance building are going to be located in highly pervious alluvium -type material. Percolation rates were measured at 5 minutes per inch (mpi) or faster. Based upon these percolation rates, a sand filter type construction for the disposal field will be required at both sites, It is important to note That the percolation testing was done at the proposed field location for the maintenance building. We are assuming at this point in time that the proposed field location for the office building will have very similar soils. However, verification (through profile hole excavation and percolation testing) will be needed prior to construction of the field at the proposed office building site. Maintenance Building ISDS Por the maintenance building, we are assuming that 10 persons per day will be tine design number of employees utilizing this facility. Based upon this employee count and the average flow rate of 15 gallons per employee per day, would yield an average flow for the maintenance building of 150 gpd. At the peak design flow, this figure would adjust up to 225 gpd. Based upon this figure, the required septic tank capacity would be at 340 gpd. However, the minimum size septic tank as required by the State Health Department is 750 gpd. Therefore, based uport septic tank minimal requirements, as mandated by the State Health Department, we have also sized the disposal field based upon these minimal requirements. We have calculated the size of the disposal field to be 223.6 square feet. This equates to a field with dimensions of 12' x 19'. We have attached a sketch which identifies the construction requirements (both in plan view and section) of the disposal field. Finally, we have also attached a sketch which identifies in schematic form the components of the ISDS. April 29, 1993 Mr. K.R. Weatherly Page 2 Office Building The design for the ISDS for the office building was based upon the observed number of offices provided within the building as well as an assumed 10 visitors per day. In essence, this system would be sized for 20 persons per day. The average daily flow, based upon 20 persons per day, would be 300 gpd. The design flow, therefore, would be 450 gpd. This would relate to a septic tank capacity of less than 750 gpd. Again, the minimal requirements mandated by the State health Department would control this design. Accordingly, the disposal field size for the office building ISDS would be based upon the minimal State Health Department requirements. The sketches, as provided and discussed above for the maintenance building, are also applicable for the office building as well. Please review the enclosed information. SGM has completed the design for the septic systems for the maintenance and office buildings at the Sievers Pit site. This design is based upon percolation data collected by SGM through percolation testing during the week of April. 19. The results of those percolation tests indicated that the proposed disposal fields for both the office building and maintenance building are going to be located in highly pervious alluvium -type material. Percolation rates were measured at 5 minutes per inch (mpi) or faster. Based upon these percolation rates, a sand filter type construction for the disposal field will be required at both sites. It is important to note that the percolation testing was done at the proposed field location for the maintenance building. We are assuming at this point in time that the proposed field location for the office building will have very similar soils. However, verification (through profile hole excavation and percolation testing) will be needed prior to construction of the field at the proposed office building site. Maintenance Building ISDS For the maintenance building, we are assuming that 10 persons per day will be the design number of employees utilizing this facility. Based upon this employee count and the average flow rate of 15 gallons per employee per day, would yield an average flow for the maintenance building of 150 gpd. At the peak design flow, this figure would adjust up to 225 gpd. Based upon this figure, the required septic tank capacity would be at 340 gpd. However, the minimum size septic tank as required by the State Health Department is 750 gpd. Therefore, based upon septic tank minimal requirements, as mandated by the State Health Department, we have also sized the disposal field based upon these minimal requirements. We have calculated the size of the disposal field to be 223.6 square feet. This equates to a field with dimensions of 12' x 19'. . We have attached a sketch which identifies the construction requirements (both in plan view and section) of the disposal field. Finally, we have also attached a sketch which identifies in schematic form the components of the ISDS. { April*29, 1993 Mr. K.R. Weatherly Page 2 Office Building The design for the ISDS for the office building was based upon the observed number of offices provided within the building as well as an assumed 10 visitors per day. In essence, this system would be sized for 20 persons per day. The average daily flow, based upon 20 persons per day, would be 300 gpd. The design flow, therefore, would be 450 gpd. This would relate to a septic tank capacity of less than 750 gpd. Again, the minimal requirements mandated by the State health Department would control this design. Accordingly, the disposal field size for the office building ISDS would be based upon the minimal State Health Department requirements. The sketches, as provided and discussed above for the maintenance building, are also applicable for the office building as well. Please review the enclosed information. Type of application: Building permit for construction of retail sales office for the sale of goods produced from raw materials on the site Property location: Sievers gravel pit, 3794 County Road 109 Zoning: A/R/RD Decision date: May 6, 2003 (by letter from Steve Hackett, Compliance Officer) Stated reason for denial: Existing special use permit does not authorize any buildings on the property Statement of Facts: Lafarge West, Inc. holds a lease on the subject property. The property is used for various purposes including the operation of a gravel pit. In accordance with Section 3.02.03 of the Zoning Resolution, special use permits are required for "extraction, processing, storage or material handling of natural resources." Special use permits have been issued for such uses, including the gravel mining (extraction) and the operation of a batch plant and an asphalt { Ft .A LEAVENWORTH & KARP, P.C. Board of Zoning Adjustment Page 2 May 13, 2003 plant (processing). There are also several other buildings on the site not specifically described in any special use permit application but for which building permits have been issued in the past, including an older sales office. The gravel operation is, and always has been, a commercial enterprise. Consistent with the extraction and processing operations, the operator has always sold the materials extracted from and processed at the site. Naturally, this includes a sales facility and scales so that the materials produced may be sold to the general public. Section 3.02.01 includes the following as a use by right under the A/R/RD district: "retail establishment for sale of goods processed from raw materials produced on the lot." Lafarge West, Inc. applied for a building permit to place a modular retail sales office on the site for this purpose as a use by right. The Building and Planning Department issued a letter on May 6, 2003, refusing to process this building permit application, purportedly because it would require a special use permit or an amendment to the existing special use permit. Basis for appeal: 1. The proposed use is a use permitted outright within the A/R/RD district. The special use permit process is not applicable. The official's decision does not address this point. No special use permit is required for permitted uses under the zone district. There is no basis to deny the permit application. This point alone requires reversal of the decision. 2. Nothing in the existing special use permits prohibits permitted uses. To the contrary, Resolution No. 81-165 (permitting the asphalt plant) specifically finds that the use is "compatible with the uses existing and permitted in the district" {italics added], and the permit was issued on the condition that the use of the tract of land comply "with all present and future regulations of Garfield County and the zone district." The resolutions approving the other special uses (gravel extraction and batch plant processing) contain similar language. Thus, the existing permits acknowledge that the general AIR/RD regulations still apply. Further, even if the special use permit process did apply (which it does not), a retail sales office is implicit in the issuance of the special use permit for a gravel pit. Gravel pits simply cannot operate without some facility to sell the gravel. County officials have previously acknowledged this by issuing permits for several existing buildings on-site, including the present sales office. it is unfair for the County to change the rules without notice after more than 20 years of operations. Apart from being an obvious part of a commercial gravel operation, none of the prior special use permit applications needed to state expressly that a retail sales office was included because that use was already permitted in the A/R/RD zone. Our position in this matter is that the Sievers Gravel Pit Special Use Permit does not give us the authority to allow buildings to be built on the property. It was issued only to allow gravel extraction and processing as well as a concrete batch plant. Former permits for the existing office building and shop on the site were issued in error.
