PROJECT: 97404.0.3 DISTRICT COURT, WATER DIVISION NO. 5, COLORADO Case No. 98CW301 FINDINGS OF FACT, RULING OF REFEREE, AND JUDGMENT AND DECREE OF WATER COURT IN THE MAI ER OF THE APPLICATION FOR WATER RIGHTS OF WAYNE RUDD, in Garfield, Pitkin and Eagle Counties, Colorado This matter came before the Court upon the Application of Wayne Rudd for change of water right and plan for augmentation. The Water Judge referred the Application to the undersigned as Water Referee for Water Division No. 5, State of Colorado, in accordance with Article 92 of Chapter 37, Colorado Revised Statutes 1973,. known as the Water Rights Determination and Administration Act of 1969. The undersigned Referee has made such investigations as are necessary to determine whether or not the statements in the Application are true, has become fully advised with respect to the subject matter of the Application and has consulted with the Division Engineer for Water Division No. 5. The Referee hereby makes the following determination and ruling as the Referee in this matter. I. FINDINGS OF FACT 1. Wayne Rudd filed an Application for Change in Water Right and Plan for Augmentation on December 31, 1998. 2. The Application was properly published in the resume for Water Division No. 5.. All notices required by law have been made, and the Court has jurisdiction over the Application and over all of the parties in this case. 3. No Statements of Opposition to the Application were filed. The time for filing such statements has expired. CLAIM FOR CHANGE OF WATER RIGHT 4. Decreed name of structure for which change is sought: Basalt Conduit 5. Information from Previous Decree: A. Date Entered: June 20, 1958 Case No. W-4613 Court: District Court, Garfield County, Colorado B. Decreed Point of Diversion: The decreed headgate and point of diversion for the Basalt Conduit is located in Pitkin County on the left side of the Frying Pan River in the NE1/4 of the NW1/4 of unsurveyed Section 18, T. 8 S., R. 84 W. of the 6th P.M. at the head of the outlet tube for Ruedi Reservoir whence the SW corner of Section 7 of T. 8 S., R. 84 W. of the 6th P.M. bears N. 79°00' W., a distance of 2, 017.1 feet C. Source: The Frying Pan River, tributary to the Roaring Fork River, tributary to the Colorado River D. Appropriation Date: July 29, 1957 Amount: 450 cfs E. Use: Generation of electricity, irrigation, domestic, municipal, stock water, piscatorial and industrial 6. Proposed change: Applicant seeks an alternate point of diversion of the Basalt Conduit in the amount of 150 gpm at either one or a combination of the following structures: A. Alabaster Well No. 1 (1) Location: SE 1/4 of the SE 1/4 of Section 7, T. 7 S., R. 88 W. of the 6th P.M. at a point 765 feet from the East Section line and 125 feet from the South Section line in Garfield County (2) Depth: 31 feet Water Division No. 5 Case No.98CW301 Applicant: Wayne Rudd Findings of Fact, Ruling of Referee, and Judgment and Decree of Water Court Page 2 (3) Source: The Cattle Creek alluvium B. Alabaster Well No. 2 (1) Location: NE 1/4 of the NE 1/4 of Section 18, T. 7 S., R 88 W. of the 6th P.M. at a point 800 feet from the East Section line and 410 feet from the North Section line in Garfield County (2) Depth: 31 feet (3) Source: The Cattle Creek alluvium C. Basalt Water Conservancy District ("BWCD") owns the Basalt Conduit water right. Applicant has a water supply contract with BWCD, No. 335, attached hereto as Exhibit A. 7. Name and address of owner of land upon which point of diversion and place of use are located: Applicant 8. Remarks: Alabaster Well Nos. 1 and 2 will provide domestic and irrigation water for employee housing units and commercial development located at the intersection of Highway 82 and Garfield County Road 113 in the NE 1/4 of the Section 18 and the SE 1/4 of Section 7, T. 7 S., R. 88 W. of the 6th P.M,. Garfield County, Colorado. The location of Alabaster Well Nos. 1 and 2 is depicted on Figure 1, attached hereto as Exhibit B. Alabaster Well Nos. 1 and 2 are not yet permitted, and Applicant will not develop the wells until he has obtained well permits. Applicant has been granted Monitoring/Observation Hole Acknowledgment No. ME -35131 for Alabaster Well No. 1. Alabaster Well No. 1 is drilled to approximately 31 feet, is designed to intercept a spring tributary to Cattle Creek, and is located approximately ten (10) feet from said spring. Applicant has been granted Monitoring/Observation Acknowledgment No. MH -35130 for Alabaster Well No. 2, which is drilled to approximately 32 feet and is within 100 feet of Cattle Creek. Applicant has a contract, No. 335, with BWCD to augment the out -of -priority depletions from the wells, as described herein. CLAIM FOR PLAN FOR AUGMENTATION 9. Name of structures to be augmented: Alabaster Well Nos. 1 and 2. Water Division No. 5 Case No.98CW301 Applicant: Wayne Rudd Findings of Fact, Ruling of Referee, and Judgment and Decree of Water Court Page 3 Are there any other water rights diverted from these structures? No. 10. Water rights to be used for augmentation: Ruedi Reservoir. Applicant has a contract, No. 335, with BWCD under which he is entitled to receive and apply to beneficial use 0.56 cfs from the District's direct flow rights and 5.3 acre feet per year of storage water owned or controlled by the District, 2.4 acre feet of which is allocated to domestic uses and 2.9 acre feet to commercial uses. The source of said storage rights is the District's water allotment contract with the Bureau of Reclamation for Ruedi Reservoir water. Ruedi Reservoir is an on -channel reservoir located in the NW 1/4 of the NE1/4 of Section 18, T. 8 S., R. 84 W. of the 6th P.M., in Eagle and Pitkin Counties. Ruedi Reservoir was originally decreed for 140,697.3 acre feet in Civil Action No. 4613, Garfield County District Court on June 20, 1958, with an appropriation date of July 29, 1957, for hydro- electric power generation, irrigation, municipal, domestic, industrial, piscatorial and stock water uses. Subsequently, in Case No. W-798-76, Water Division No. 5, the amount of water decreed to Ruedi Reservoir was reduced from 140,697.3 acre feet to 102,369 acre feet. 11. Statement of Plan for Augmentation: A. Water will be diverted from the Alabaster Well Nos. 1 and 2 as alternate points of diversion for the Basalt Conduit, on a year-round basis, for domestic use and lawn and garden irrigation associated with employee housing units (30 equivalent residential units (EQR)) and a commercial development (37.4 EQR) on approximately 70 acres, as more fully described in paragraph 8., above. B. Each employee housing unit is estimated to require an average of 300 gallons per day ("GPD"), based upon 3 persons using 100 GPD each. Depletions associated with domestic in-house use are estimated to be 15%; waste water treatment will be by septic tank/leach field system. The contemplated in-house demand for the employee housing units (30 EQR) is estimated to be 10.080 acre feet annually, resulting in annual depletions of 1.512 acre feet. Commercial in-house demand for 37.4 EQR is estimated to be 12.566 acre feet annually, and is considered to be 15% consumptive, resulting in annual depletions of 1.885 acre feet. The total irrigated area for the commercial and residential units (67.4 EQR) is estimated to be 33,700 square feet. Irrigation demand is 2.13 acre feet per acre, assuming an 80% irrigation efficiency. Irrigation depletions are contemplated to be 1.8 acre feet per year. Water Division No. 5 Case No.98CW301 Applicant: Wayne Rudd Findings of Fact, Ruling of Referee, and Judgment and Decree of Water Court Page 4 C. The projected total diversion requirement for these augmented uses is 24.703 acre feet annually, with a projected annual consumptive use of 5.295 acre feet (which includes a 5% transit loss for the augmentation releases). Exhibit C hereto is a table summarizing the contemplated monthly diversion and depletion amounts. Applicant will provide a delayed impacts analysis consistent with the BWCD Decree in Case No. 87CW155. Consistent with prior BWCD decrees, Applicant has anticipated that the Basalt Conduit is in priority during .the months of December through March and May. Augmentation is required only when the Basalt Conduit is out of priority. Applicant may change the mix of uses contemplated to be augmented herein, so long as the total depletions to be replaced do not exceed the depletions contemplated herein. D. The Applicant's water service contract with BWCD will be sufficient to allow uninterrupted diversions from the wells, and prevent injury to other vested and decreed conditional water rights. II. CONCLUSIONS OF LAW 1. The foregoing findings of fact are fully incorporated herein. 2. Notice of the Application was properly given. The Court has jurisdiction over the Application and over all persons or entities who had standing to appear, even though they did not do so. 3. The Application is complete, covering all applicable matters required pursuant to the Water Right Determination and Administration Act of 1969, C.R.S. §§ 37-92-101 through -602. 4. The Court has given due consideration to the Division Engineer's Summary of Consultation dated April 28, 1999. See C.R.S. §37-92-302(4). 5. Applicant has fulfilled all legal requirements for a decree for the requested change of water right including C.R.S. §§ 37-92-302 and 37-92-305. 6. Applicant has fulfilled all legal requirements for a decree for the requested plan for augmentation including C.R.S. §§ 37-92-302 and 37-92-305. Water Division No. 5 Case No.98CW301 Applicant: Wayne Rudd Findings of Fact, Ruling of Referee, and Judgment and Decree of Water Court Page 5 7. The change of water right described herein will not injuriously affect the owner of or persons entitled to use water under a vested water right or a decreed conditional water right. 8. If operated in accordance with the terms and conditions of this decree; the plan for augmentation described herein will prevent injury to senior vested or decreed conditional water rights. 9. The subject Application is in accordance with Colorado law. Applicant has fulfilled all legal requirements for entry of a decree in this case. III. TUDGMENT AND DECREE 1. The foregoing findings of fact and conclusions of law are incorporated herein. ?. The Court hereby confirms and decrees an alternate point of diversion for the Basalt Conduit at the Alabaster Well Nos. 1 and 2, as described herein. herein. 3. The Court hereby decrees and approves the plan for augmentation described 4. In consideration of the specific findings and conclusions made herein, and in conformance with C.R.S. § 37-92-304(6) (1990), as amended, the change of water right and plan for augmentation decreed herein shall be subject to reconsideration by the Water Judge on the question of injury to the vested water rights of others for a period of five years from the date of issuance of building permits for 75% of the EQR's authorized herein. If no petition for reconsideration is filed within said five years, retention of jurisdiction for this purpose shall automatically expire. Any party who wants the Court to reconsider the question of injury must file a verified petition with the Court, setting forth the facts that cause such injury and explaining the claimed injury. The party filing the petition shall have the burden of proof to establish the facts and the injury alleged in the petition. 5. In conformance with Colo. Rev. Stat. § 37-92-305(8), the State Engineer shall curtail all out -of -priority diversions, the depletions from which are not so replaced as to prevent injury. Applicant shall install measuring devices, provide accounting, and supply calculations regarding the timing of depletions as required by the Division Engineer for the operation of this plan. The applicant shall designate a representative responsible for filing an annual report with the Division Engineer by November 15`h of each year summarizing diversions and replacements made under this plan. 7. Prior to any change of the mix of uses, Applicant shall submit an accounting form to the Division Engineer that correctly identifies and accounts for the proposed mix of water uses for prior approval of the Division Engineer. 8. Review of determinations made by the Division Engineer or the State Engineer in administration of the change of water right and plan for augmentation are "water matters" which the Water Court may review de novo and over which the Water Court has exclusive jurisdiction. 9. Applicant is required to obtain and maintain valid well permits issued pursuant to C.R.S. §37-90-137(2) and this plan for augmentation prior to construction and/or operation of Alabaster Well Nos. 1 and 2. 10. Alabaster Well Nos. 1 and 2 shall be administered as surface diversions for the purposes of calculating the timing of depletion impact to the stream. 11. Applicant is required to file a copy of an approved Basalt Water Conservancy District contract for replacement water from Ruedi Reservoir before the augmentation plan herein is effective. Applicant has provided a copy of said Contract to the Division Engineer for Water Division No. 5. It is accordingly ordered that this ruling of Referee and judgment and decree shall be filed with the Water Clerk and shall become effective upon such filing, subject to judicial review pursuant to C.R.S. § 37-92-304, as amended. It is further ordered that a copy of this ruling of Referee and judgment and decree shall be filed with the State Engineer and the Division Engineer for Water Division No. 5. In the event the water right allotted hereunder is to be used for the benefit of land which is now or will hereafter be subdivided or otherwise held or owned in separate ownership interest by two (2) or more uses c f the water right allotted hereunder, the Applicant nay assign the Applicant's rights hereunder only to a homeowners association, water district, water and sanitation district or other special district properly organized and existing under and by virtue of the laws of the State of Colorado and then only if such association or special district establishes to the satisfaction of the Basalt Water Conservancy District that it has the ability and authority to assure its performance of the Applicant's obligations under this Contract. In no event shall the owner of a portion, but less than all: of the Applicant's property to be served under this Contract, have any rights hereunder. except as such rights may exist through a homeowners association or special district as above provided. The Alabaster Wells #1 and #2 were drilled by Shelton Drilling Corporation. An application for water allotment contract with the Basalt Water Conservancy District (attached) was filed on December 28, 1998 and an Application for Change of Water Right and Plan for Augmentation (attached) was filed in District Court, Water Division 5 on December 31, 1998. The test wells are currently registered as monitoring holes with the Division of Water Resources under permit Nos. MH -35130 and MH-35131(Notices of Intent and Acknowledgment for each well are attached). Alabaster #1 is located in the SE 1/4 of the SE 1/4 of Section 7, Township 7 South, Range 88 West of the 6th P.M. at a point 765 feet from the East section line and 125 feet from the South section line. Alabaster #2 is located in the NE 1/4 of the NE 1/4 of Section 18, Township 7 South, Range 88 West of the 6th P.M. at a point 800 feet from the East section line and 410 feet from the North section line. The approximate locations of the wells are shown on the attached site map (Figure 1). We have reviewed J and M Pump Company's recent pump tests on the subject wells. Alabaster #1 and Alabaster #2 were both drilled to a depth of 29 feet and constructed with 7 -inch diameter steel well casing. The water bearing portions of the wells are in the Cattle Creek alluvium. The static water level in the Alabaster #1 on December 22, 1998 was 3.0 feet below the top of the well casing. The available drawdown in Alabaster #1 is approximately 26.0 feet (29.0 ft - 3.0 ft). The static water level in the Alabaster #2 on December 22, 1998 was 7.0 feet below the top of the well casing. The available drawdown in Alabaster #2 is approximately 22.0 feet (29.0 ft - 7.0 ft). The attached Figure 2 has been prepared to illustrate the well construction details and geologic log for both wells, since both wells share similar construction and were drilled into the same alluvial formation. The well construction reports from Shelton Drilling Corporation are attached. Page 1 Both wells were tested on December 22, 1998 through December 29, 1998 by J and M Pump Company. A 2 horsepower pump powered by line power was installed in Alabaster #1 for the test. A pumping rate of 85 gallons per minute (gpm) was selected. Alabaster #1 was pumped continuously for a 168 hour period at a rate of 85 to 88 gpm. Drawdown and time data were collected during the test and are presented in the attached Table 1. The drawdown data can be used to project the yield of a well and associated aquifer. The drawdown is the distance the water level drops from the initial static water level and can vary over time, depending on the pumping intensity. We have plotted the pump test data in a drawdown vs. time curve for Alabaster #1. The graph is shown on the attached Figure 3. The well drawdown was approximately 4 feet over the first hour of the test and reached a maximum of 5.3 feet 44 hours into the test. The water level while pumping at 85 to 88 gpm stayed well above the pump intake level of 27 ft during the pumping test. Alabaster #2 was tested with a 1.5 horsepower pump, also powered by line power. This well was pumped at a rate of 50 gpm throughout its test. Drawdown and time data were collected during the test and are presented in the attached Table 2. The graph of the data is shown on the attached Figure 4 Based on the available drawdown Alabaster #1 and #2 should be able to pump continuously at the test rates of 85 and 50 gpm, respectively. The flat drawdown curves would indicate the wells were being recharged at the same rate as they were being pumped. Recovery data for the wells were collected for a 3 hour period after pumping had stopped. The recovery data for Alabaster #1 and #2 are presented in Tables 1A and 2A, respectively and are plotted as residual drawdown in Figures 3A and 4A, respectively. Based on the residual drawdown curve, the wells displayed positive recharge characteristics, or in other words, the wells recovered at a greater rate than they were pumped. Alabaster #1 returned to within one foot of its original static water level within the first minute and to its original static level within 90 minutes. Alabaster #2 returned to a point above its original static water level in the first minute of recovery. These results would indicate that water pumped during the tests was rapidly recharged from the surrounding Cattle Creek alluvium. The recovery of these wells is common to wells drilled in alluvial materials near a stream. Finally, a suite of water samples of the pumping discharge from Alabaster #1 were collected. It was decided to wait until results are received from tests on Alabaster #1 before proceeding to test Alabaster #2. The water from Alabaster #1 was tested for bacteria, inorganic chemicals (IOCs), volatile organic chemicals (VOCs), synthetic organic chemicals (SOCs) and radiology (gross alpha and beta). The results of the bacteria test were negative. A copy of the results is attached. The remainder of the analyses are being performed by Barringer Laboratories in Golden, Colorado. The study was conducted in accordance with our agreement for geotechnical engineering services to Rudd Construction, Inc. dated December 8, 1998. The data obtained and our preliminary recommendations based on the assumed construction and subsurface conditions encountered are presented in this report. Evaluation of potential geologic hazard impacts at the site are beyond the scope of this study. Proposed Development: At the time of our study, design plans for the commercial development were conceptual. The development is proposed in the less steep portions of the property. The development area in the east part for Parcel B (Fig.1) is proposed to be extended to the northeast toward Cattle Creek by placement of structural fill. We assume the commercial buildings will be one to two story buildings with slab -on -grade floors. Cut depths are expected to range between about 3 to 4 feet. Foundation loadings for this type of construction are assumed to be relatively light and typical of the assumed type of construction. The development will be serviced by a central water and septic systems. If development plans change significantly from those described above, we should be notified to reevaluate the recommendations presented in this report. Site Conditions: The development is located to the west of Cattle Creek on the east side of the Roaring Fork River Valley. The general topography is shown on Figs. 1 and 2. The ground surface in the development area typically slopes strongly to moderately steep at grades between about 10% to 30%. The terrain becomes steeper to the south of the development area on Fig. 1 and to the east of the development areas on Fig. 2. Vegetation consists of grass, weeds scattered sagebrush, scruboak and pinon Rudd Construction, Inc. February 25, 1999 Page 2 trees. The existing road in the eastern area, shown on Fig. 1, was being constructed at the time of our field work. Eagle Valley Evaporite bedrock was exposed in the Parcel C area of the development and underlies Parcel B. Subsurface Conditions: The subsurface conditions at the site were evaluated by observing one exploratory pit and three profile pits at the approximate locations shown on Figs. 1 and 2. The logs of the pits are presented on Fig. 3. The subsoils encountered, below about 1 foot of topsoil, consist of clayey to silty sand and gravel. Sandy clay and silt was encountered beneath the topsoil in Pit 1 to the depth excavated, 71 feet. Results of consolidation testing performed on a relatively undisturbed sample of sandy silt, presented on Fig. 4, indicate low compressibility under existing moisture conditions and light loading and a low collapse potential (settlement under constant load) when wetted. The sample showed moderate compressibility upon additional loading after wetting. Results of a gradation analysis performed on samples of the gravel (minus 3 inch fraction) obtained from the site are presented on Fig. 5 and 6. No free water was observed in the pits and the soils were slightly moist to moist. Percolation Testing: Percolation tests were conducted in the area on December 17, 1998 to evaluate the feasibility of an infiltration septic disposal systems on the property. Three profile pits and nine percolation holes were dug at the locations shown on Figs. 1 and 2. The test holes (nominal 12 inch diameter by 12 inch deep) were hand dug at the bottom of shallow backhoe pits and were soaked with water one day prior to testing. The soils exposed in the percolation holes are similar to those exposed in the adjacent profile pits shown on Fig. 3. The percolation test results are presented in Table II. The percolation test rates varied from 6 to 20 minutes per inch with an average rate of 13 minutes per inch in the area of Profile Pit 1 (Fig. 1) and an average rate of about 12 minutes per inch in the area of Profile Pits 2 and 3 (Fig. 2). Based on the subsurface conditions encountered and the percolation test results, conventional infiltration septic disposal systems appear feasible for the development. Preliminary Design Recommendations: The conclusions and recommendations presented below are based on the proposed construction, subsurface conditions encountered in the exploratory pits and our experience in the area. The recommendations are suitable for planning and preliminary design but site specific studies should be conducted for individual building development. H -P GEOTECH Rudd Construction, Inc. February 25, 1999 Page 3 Bearing conditions will vary depending on the specific location of the building on the property. Based on the nature of the proposed construction spread footings bearing on the natural subsoils or compacted structural fill should be suitable at the building sites. We expect the footings can be sized for an allowable bearing pressure in the range of 1,000 psf to 2,000 psf. There could be differential settlement between portions of the buildings on the fill and portions on the natural soils. Settlements of the natural soils should be expected if they become wetted. The amount of settlement would be related to the depth of settlement -prone soil and the extent of wetting. Structural fill below footing areas should be compacted to at least 100% at standard Proctor density at a moisture content near optimum. The fill should extend beyond the footing edge a distance equal to at least the depth of fill below the footing. Materials proposed for structural fill should be evaluated by the geotechnical engineer prior to placement. Foundation walls should be designed to span local anomalies and to resist lateral earth loadings when acting as retaining structures. Below grade areas and retaining walls should be protected from wetting and hydrostatic loading by use of an underdrain system. The footings should have a minimum depth of 36 inches for frost protection. Parcel B is underlain by Pennsylvania Age Eagle Valley Evaporite bedrock. The evaporite contains gypsum deposits. Dissolution of the gypsum under certain conditions can cause sinkholes to develop and can produce areas of localized subsidence. Sinkholes were not observed in the proposed development area. The exploratory pits were relatively shallow, for foundation design only. Based on our present knowledge of the site, it cannot be said for certain that sinkholes will not develop. In our opinion, the risk of ground subsidence at Parcel B is low but the owner should be aware of the potential for sinkhole development. Floor Slabs: Slab -on -grade construction should be feasible for bearing on the natural soils. There could be some post construction slab movement if the subsoils become wetted. To reduce the effects of some differential movement, floor slabs should be separated from all bearing walls and columns with expansion joints. Floor slab control joints should be used to reduce damage due to shrinkage cracking. A minimum 4 -inch layer of free draining gravel should underlie basement level slabs (if any) to facilitate drainage. This material should consist of minus 2 inch aggregate with less than 50% passing the No. 4 sieve and less than 2% passing the No. 200 sieve. H -P GEOTECH Rudd Construction, Inc. February 25, 1999 Page 4 All fill materials for support of floor slabs should be compacted to at least 95 % of maximum standard Proctor density at a moisture content near optimum. Required fill can consist of the on-site soils devoid of vegetation, topsoil and oversized rock. Site Grading: The risk of construction induced slope stability at the site appears low provided the buildings are located in the less steep parts of the property as planned and cut and fill depths are limited. We expect cut/fill depths for the building pads and access roads will not exceed about 10 feet. Structural fills should be compacted to at least 95 % (100% below footing grade) of the maximum standard Proctor density near optimum moisture content. Prior to fill placement, the subgrade should be carefully prepared by removing all vegetation and topsoil. The fill should be benched into slopes exceeding 20 % grade. The on-site soils excluding topsoil and oversized rock should be suitable for use in embankment fills. Permanent unretained cut and fill slopes should be graded at 2 horizontal to 1 vertical of flatter and protected against revegetation, rock riprap or other means. This office should review site grading plans for the project prior to construction. Surface Drainage: The grading plan for the development should consider runoff from steep uphill slopes through the project and to individual sites. Water should not be allowed to pond which could impact slope stability and foundations. To limit infiltration into the bearing soils next to the buildings, exterior backfill should be well compacted and have a positive slope away from the buildings for a distance of 10 feet. Roof downspouts and drains should discharge well beyond the limits of all backfill and landscape irrigation should be restricted. Limitations: This study has been conducted in accordance with generally accepted geotechnical engineering principles and practices in this area at this time. We make no warranty either expressed or implied. The conclusions and recommendations submitted in this report are based upon the data obtained from the exploratory pits excavated at the locations indicated on Figs. 1 and 2, the assumed type of construction and our experience in the area. Our findings include interpolation and extrapolation of the subsurface conditions identified at the exploratory pits and variations in the subsurface conditions may not become evident until excavation is performed.
