Reception No. 343674375 MILDRED ALSDORF, RCORDEF At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Commissioners' Annex in Glenwood Springs, Colorado, on Monday , the 31st day of January , A.D. 19 83 , there were present: Eugene "Jim" Drinkhouse Larry Velasquez Flaven J. Cerise Earl Rhodes Stan Broome Mildred Alsdorf , Commissioner Chairman , Commissioner , Commissioner , County Attorney , County Manager , County Clerk when the following proceedings, among others were had and done, to wit: RESOLUTION NO. 83-26 RESOLUTICE CCIVCERNED WITH THE APPROVAL OF THE SKETCH PLAN SUBMITTAL FOR THE CATTLE CREEK RANCH PLANNED UNIT DEVELOPMENT WHEREAS, the Cattle Creek Ranch Joint Venture has filed an application with the Board of County Commissioners of Garfield County, Colorado, for approval of a sketch plan for the Cattle Creek Ranch Planned Unit Development; WHEREAS, based upon the material submitted by the applicant, and the comments of the Garfield County Planning Department and the Garfield County Planning Commission, this Board finds as follows: a. That proper publication and public notice was provided as required by law; b. That the meeting before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting; c. That the proposed sketch plan is in compliance with the recommendations set forth in the master plan for the unincorporated area of the county; d. That the sketch plan conforms to the requirements of the Garfield County Subdivision Regulations; e. That the sketh plan conforms to the requirements of the Planned Unit Development in which the development is located; and f. That the for the above stated and other reasons, the sketch plan qualifies for approval by this Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, that the sketch plan for the Cattle Creek Ranch Planned Unit Development be approved for the following described unincorporated area of Garfield County, with the following stated conditions: 1. The applicant, Cattle Creek Ranch Joint Venture, shall agree to the vacation of the final plat, which was approved on July 28, 1980, and the previous Planned Unit Development Zoning, which was authorized by Resolution No. 77-113, which approval shall be evidenced by a document submitted to the Board prior to the Board's signing of this Resolution. 2. That, except for the property described below, the balance of the applicant's property, which was included in Resolution No. 77-113, shall now be zoned Agricultural/Residential/Rural Density. 3. The applicant shall petition into the Carbondale Rural Fire Protection District. .• •• BMX G19 pr(4 ' 4. That, prior to preliminary plat approval, the applicant shall demonstrate, to the satisfaction of the Board of County Commissioners, that it has an adequate fire protection plan to protect the cluster housing. 5. That the location of the sewage treatment plan, water treatment plan and water tank shall be shown on subsequent plats. 6. That the applicant, by way of Homeowner Covenants, shall make provision for the private maintenance of the subdivision roads, and emergency road access into the subdivision for the benefit of the public. The roads within the subdivision shall be private. 7. The maximum number of dwelling units on the property described in Ekhibit "A" shall be one hundred thirty-one (131), which fact shall be denoted on the subsequent plats. 8. Pedestrian ways shall be shown and labeled on subsequent plats. 9. The applicant shall design its project so that the private rights of all ditchowners with rights and/or interests in ditches which cross the subject property are protected in accordance with law. 10. The applicant shall complete the construction of the connecting road to County Road 100. LEGAL DESCRIPTION: See attached Exhibit "A" attached hereto and incorporated herein by reference.
