Dear Michael
Thank you for submitting to the County the mylar of the Monument Ridge Subdivision
Amended Plat. While some of the final signatures have been obtained, we understand
you are in the process of finalizing details and obtaining a signature from the County
Treasurer on the Certificate of Taxes Paid. We have received your request for a 60 day
extension on recording the plat to allow completion of that process.
ln addition, thank you for submitting the originals of the other documents to be recorded.
Per our conversations with your office, you will also need to provide an executed copy
of the Easement Acknowledge Document previously prepared by your office for
recording.
Your extension request has been granted to allow for an additional 60 days to finalize
signatures and submit your plat in a form ready for recording. The Amended Plat for Lot
5 of the Monument Ridge Subdivision and related documents for recording will need to
be provided to the County by April 27th. Please contact us with any additional questions
or updates.

Dear Glenn,
When I spoke to the Treasurer's office they informed me that the tax payment due date for the of the first half of the
year is February 28, and that while the taxes for both parcels are due, they are not late, but had not yet been paid. So
we will be unable to Bet a certificate of taxes paid until next week at the earliest.
Additionally, we have been unable to contact Mr. Trani in the last few days to check on the status of his tax payment, so
I guess we will need to hold off on getting on the BOCC agenda until the next meeting.

Hi Michael and Angelique:
The County Surveyor has signed the Trani Monument Ridge Amended Plat.
The next step is the County Treasurer sign off on the Certificate of Taxes Paid. I checked in with their Office
and the process is still the same including a review by their office, generation of a report indicating if the taxes
are paid (a small fee is required), and signing of the plat by the Treasurer if they are all paid. They will need the
parcel numbers of the two properties involved which by my files are 2407 -202-26-005 and 2407 -202-00-048.
You should contact the Treasurer's Office as soon as possible as it sometimes takes a day or so to coordinate
with their schedules. When they are ready to sign the plat you can come by and pick it up or I can deliver it to
their office. Getting this taken care of this week will allow us to get you on the next Board agenda.
I have also attached the Easement Acknowledgement Document that your office provided as part of the review.
I checked in with Kelly Cave, our Assistant County Attorney and she still feels that it is an appropriate

document to include in your recording that clarifies that an easement will still exist on the properties in the area
where the lot line adjustment is occurring. Once the document is executed please bring the original to our office
and we will include it in the recording packet.
There are a couple insertions in the documents that may warrant you being represented at the time of recording
The recording information for the BLA Affidavit needs to be added to the plat and the Quit Claim Deed needs
to be dated (this can be done by your office any time prior to recording)
Once I have all the documents we can calculate a final total for the recording fees. A preliminary estimate is as
follows along with the order of recording as directed by Kelly Cave.
lst Recording: BLA Affidavit (4 pages): $11 + $15 = $26
2nd Recording: Quit Claim Deed (2 pages): $11 + $5 = $16
3rd Recording: Easement Acknowledgement (3 pages): $11 + $10 = $21
4th Recording: Plat: $11
Estimated Total Recording Fees =$14

Dear Glenn:
Enclosed with this letter you will find the original Amended Final Plat for Monument Ridge
Subdivision, Lot 5 (owned by Brian Trani). This Plat has now been executed by the owner, the
owner's surveyor, the title company, and Alpine Bank as the lien holder. The remaining blocks on
the plat to be filled out include the County Commissioners' Certificate, the Certificate of Taxes
Paid, the County Surveyor's Certificate, and then the recording information from the Clerk and
Recorder. In other words, I believe we have completed what we needed to do and the Plat is
tendered to Garfield County for the completion of the process. I am also including with this letter
the original Boundary Line Adjustment Affidavit. This affidavit is accompanied by a Quit Claim
Deed and a letter describing the boundary line adjustment. These documents meet the requirements
of the boundary line adjustment provisions of the County Code. It is my understanding that the
County will record the Final Plat. I believe it makes sense for the boundary line adjustment
affidavit and accompanying documents to be recorded immediately thereafter. We will of course
reimburse the County for all recording costs.

This procedure applies to property owners who wish to amend the adjoining boundaries between
adjacent "metes and bounds" parcels in unincorporated Garfield County. lf one of the properties is a lot
located within a recorded subdivision, that owner shall also be required to seek approval from the Board
of County Commissioners for a Final Plat Amendment which is more fully defined in Article 5 of the
Garfield County Land Use and Development Code.

last signature hereto by Daniel Gardner and Mark Gardner (collectively, "Gardners').
RECITALS
This Acknowledgment is made with reference to the following facts:
WHEREAS, Gardners own a parcel of land comprising the Ell? NWl/4 NWI/4 of
Section 20, Township 7 South, Range 95 West of the 6th P.M., in Garfield County, Colorado
known by Garfield County Assessor's Parcel No.240720200048 (the "Property"); and
WHEREAS, a portion of the western boundary of the Property is shared in common
with a parcel of land owned by Brian Trani ("Trani") and known as Amended Lot 5,
Monument Ridge Subdivision, Garfield County Assessor's Parcel No.240720226005 ("Lot 5");
and
WHEREAS, the Gardners and Trani desire to adjust the common boundary of the
Property and Lot 5 to follow a historic fence that is located on Lot 5 westerly of the legal
boundary of the Property; and
WHEREAS, a twenty feet wide utility and drainage easement ("Easemenf') burdens
Lot 5 and a portion ofthe Easement is located easterly ofthe historic fence; and
WHEREAS, adjustment of the common boundary of the Property and Lot 5 to follow
the historic fence results in the portion of the Easement being located on the Property; and
WHEREAS, the Easement will burden the Property upon adjustnent of the boundary
line shared with Lot 5 and be a benefit to third parties for the purposes described on the
Final Plat of the Monument Ridge Subdivision recorded at Reception No. 679333 (the
"Plat"); and
WHEREAS, Gardners wish to acknowledge the existence of the Easement, its
burden on the Propedy, and its benefits to third parties.
ACKNOWLEDGEMENT
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
consideration, and intending to be legally bound, Gardners acknowledge as follows:
1. Incorporation of Recitals. The Recitals set forth above are incorporated herein.
2. Easement Burdens Property. Gardners acknowledge that the portion of the
Easement depicted on Exhibit A hereto now burdens the Property and continues to provide
benefit for third parties for the purposes described on the Plat. Gardners further
acknowledge that the adjustrnent of the common boundary of the Properly and Lot 5 to
follow the historic fence line should in no way be deemed to abandon or terminate the
Easement or to diminish, impair, waive, or amend the riglrts of legally authorized third
parties to use the easement for its intended purposes.
3. Binding Effect. This Acknowledgment is intended to be binding upon
Gardners and their successors and assigns, is intended to run with the Property, and is
intended for the
