PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Extension of P.U.D. Zoning for
Cattle Creek Ranch

LOCATION:
I. DESCRIPTION OF THE PROPOSAL
A tract of land situated in Section
8 and 5, Township 7 South, Range 87
West of the 6th P.M., located
approximately 9 miles northeast of
Carbondale off of County Rd. 113.
In January of 1983, by Resolution 83-27, modification of the Cattle
Creek Ranch P.U.D. was approved by the Board of County Commissioners.
(See pages 'b ). The P.U.D. was proposed to consist of 131 dwelling
units on 319.2 acres. The development was to include single family
dwelling, residential/cluster dwelling, open space, and
recreational/equestrian areas.
The applicants are requesting an extension of 36 months on their
P.U.D. approval. Improvements and efforts toward initiation of the
development include: road construction, well and waterline
improvements, flood control improvements, and design guidelines for
the major equestrian facility. (See pages 7-9
II. MAJOR ISSUES AND CONCERNS
Section 4.09.01 of the Garfield County Zoning Resolution of 1978, as
amended, states that "the applicant must begin development of the
P.U.D. within one year from the time of its final zone change
approval, provided, however, that the P.U.D. may be developed in
stages."
In addition, Condition #8 of the Cattle Creek Ranch P.U.D. approval
requires that within one year of Sketch Plan approval, the applicant.
shall apply for Preliminary Plan approval but it does make allowance
for extension requests. The Sketch Plan for the Cattle Creek P.U.D.
was also approved in January, 1983 by Resolution No. 83-26.
Litigation associated with the development was recently resolved on
June 3, 1986 and the County Attorney's office has advised that
required time lines should be based on that date. The applicants'
extension request is timely based on the County Attorney's
determination. Any extension approval should include extension of the
Sketch Plan approval and a corresponding change in the development
schedule.
III.SUGGESTED FINDINGS
1. That proper publication and public notice was provided as
required by law for a public hearing before the Board of County
Commissioners;
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all facts, matters and issues were
submitted and that all interested parties were heard at the
hearing;

3. That the P.U.D. Zoning and Sketch Plan Extension request were
referred to the Garfield County Planning Commission for review
and a recommendation of approval of said extension request was
made on July 8, 1987; and
4. That Section 4.09.01 of the Garfield County Zoning Resolution of
1978, as amended, requires a developer to begin development of a
P.U.D. within one (1) year of the final zone change approval;
5. That the applicant has demonstrated progress toward completion of
the development and has submitted said extension request within
required time limits.
6. Thatfor the above stated and other reasons, the extension
request is in the best interest of the health, safety, morals,
order, convenience, prosperity and welfare of the citizens of
Garfield County.
IV. RECOMMENDATION
The Planning Commission recommended to the Board of County
Commissioners, on June 10, 1987, approval of the extension request for
the Cattle Creek Ranch P.U.D. for a period of 36 months subject to the
understanding that all other conditions of approval contained in
Resolution No. 85-27 shall remain in force and effect.
