BOUN DARY LINE ADJUSTMENT AFFIDAVIT
The undersigned affiants being first sworn upon thereof, depose and state as follows:
1) We are the owners of real property in the unincorporated area of Garfield County, which is
described in Exhibit A (also known as a Quit Claim Deed) which is attached hereto and
incorporated herein by reference.
2) We are desirous of adjusting the boundary lines of our parcels andf or lots and sign this Affidavit
in accordance with the Garfield County Unified Land Use Resolution of 2008, as amended,
3) We hereby represent that no new parcels or lots will be created and therefore, that Garfield
County will not be required to issue any building permits, other than what it would be required
to issue forthe already existing parcels or lots.
4) We hereby representthat none of the parcels or lots involved in this boundary line adjustment
are part of a previously platted subdivision of record. lf one of the lots to be amended is a lot in
a previously recorded subdivision, then a Final Plat Amendment is required which is more fully
defined in article 5 of the Garfield County Unified Land Use Resolution of 2008, as amended,
5) We hereby represent that the boundary Iine adjustment made reference to herein will not
cause the loss of access by road or to utilities, to any parcel or lot involved.
6) We hereby represent that the boundary line adjustment being made will not result in any of the
parcels or lots involved being less than the minimum lot size in their applicable zone district
allowed as a result of the boundary line adjustment or create any non-conforming setbacks for
a ny exi sting structures.
7) We hereby represent that a copy of the Affidavit will be recorded with the Garfield County Clerk
and Recorder.

EASEMENT ACKNOWLEDGMENT
This Easement Acknowledgment ('Acknowledgmenf) is executed as of the date of the
last signature hereto by Daniet Gardner and Mark Gardner (cotlectively, ,.Gardners,).
RECITALg
This Acknowledgment is made with reference to the following facts:
WHEREAS, Gardners own a parcel of land comprising the El/Z NWI/4 NWI/4 of
Section 20, Township 7 South, Range 95 West of the 6th P.M., in Garfield County, Colorado
known by Garfield County Assessor's Parcel No.240720200048 (the ,.properry',); and
WHEREAS, a portion of the westem boundary of the Property is shared in commonwith a parcel of land owned by Brian Trani ("Trani') and known as Amended Lot 5,
Monument Ridge Subdivision, Garfield County Assessor's Parcel No. 24072 O2z600s ( Lot 5,);
and
WHEREAS, the Gardners and Trani desire to adjust the common boundary of theProperty and Lot 5 to follow a historic fence that is located on Lot 5 westerly of the legal
boundary ofthe Property; and
WHEREAS, a twenty feet wide utility and drainage easement ("Easement,) bqrdens
Lot 5 and a portion of the Easement is located easterly of the historic fence; and
WHEREAS, adjustnent of the corrmon boundary of the property and Lot 5 to follow
the historic fence results in the portion ofthe Easement being located on the property; and
WHEREAS, the Easement will burden the Property upon adjustnent of the boundaryline shared with Lot 5 and be a benefit to third parties for the purposes described on theFinal Plat of the Monument Ridge Subdivision recorded at Reception No. 679333 (theo?lat"); and
WHEREAS, Gardners wish to aclarowledge the existence of the Easemen! its
burden on the PropertSr, and its benefits to third parties-
ACKNOWLEDGEMENT
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
consideration, and intending to be legally bound, Gardners acknowledge as foliows:
1' Incorporation of Recitalq. The Recitals set forth above are incorporated herein.
2' Easement Burdens Propertv. Gardners acknowledge that the portion of the
Easement depicted on Exhibit A hereto now burdens the Property and continues to provide

Gardners furtheracknowledge that the adjustnent of the common boundary of the property and Lot 5 tofollow the historic fence line should in no way be deemed to abandon or terminate theEasement or to diminish, impair, waive, or amend the rights of legally authorized thirdpanies to use the easement for its intended purposes.
