The proposed subdivision is a division of an existing lot into two lots. The lots are located to the north of the Aspen Glen Planned Unit Development. North and west of the property is the Teller Springs Subdivision. South of the property is the Aspen Glen treatment plant and the Lafarge gravel pit. The Roaring Fork River borders the property on the east. There are currently two existing residences on the property owned by George Sherick. One well on the site serves the two residences. The existing well permit has been attached. The existing well currently serves the two existing residences. These residences are served by two separate Individual Sewage Disposal Systems (ISDSs). Please see the attached Sketch Plan map for well location, and approximate ISDS field locations. The proposed boundary divides the property into two lots (4.6 acres and 2.6 acres). It is proposed that these lots continue to be served by their existing ISDSs. It is also proposed that the two residences receive service for electricity, natural gas, telephone, and cable television from the existing companies that are currently providing service to the residences. This subdivision is expected to have little or no impact on the lakes, streams and topography of the site as no new improvements are proposed. There appear to be no wetlands in the buildable area above the 100 -year floodplain. There are no anticipated radiation hazards on the site. The subdivision is accessible via County Road 109 and Fisherman's Road, which also serves as the access for the Aspen Glen Wastewater Treatment Plant site. Please see the attached Aspen Glen Plat filed by Schmueser Gordon Meyer, Inc. for the location of the access easement for the property. The access is essentially a dead-end drive that exceeds the normal County criteria for maximum length, but since the proposed lots are already occupied by existing residences, we request that the maximum length criteria be waived for this subdivision. The soils present on the property are Atencio-Azeltine complex, and Redrob loam. The Atencio-Azeltine complex is found on alluvial fans and terraces. The ratio of Atencio sandy loam to Azeltine gravelly sandy loam is 60%:30%. Both types of soil are deep and well drained with rapid to very rapid permeability below a depth of 16 inches in the Azeltine soil. The Redrob loam soil is characteristically found on alluvial valley floors, low terraces, and flood plains. This type of soil is deep and somewhat poorly drained, with moderate permeability. Small areas of Atencio and Azeltine soil, among others, are frequently found in this soil. Please see the attached Soil Conservation Survey Map for locations of these soil types present on the property. Although the property appears to be designated as Low Density Residential by the Comprehensive Plan's Land Use Districts Map, the site is surrounded by approved developments (Aspen Glen PUD, Teller Springs & Sanders Ranch PUD) with densities or lot sizes not dissimilar to the Sherick Sketch Plan. Furthermore, there will be no increase in density since there is an existing residence on each proposed lot. Given the properties proximity to the Roaring Fork Water and Sanitation District Sewer Treatment Plant, it would be feasible for the lots to acquire sewage treatment services from the District if they were needed in the future. Since the proposed lots are currently occupied by residences built on gentle slopes above the 100 Year Floodplain with minimal environmental impact, have access to centralized utility services and are surrounded by existing development of similar character, this two lot subdivision seems to be compatible with the goals and methodology of the Comprehensive Plan if not with the specific Land Use District as mapped by the Comprehensive Plan. This unit is about 45 percent Showalter very stony loam and 35 percent Morval loam. The Showalter soil is in convex areas, and the Morval soil is in the more concave areas. APPLICANT: Douglas Miller LOCATION: A tract of land situated in Lot 25, Section 12, T7S, R89W of the 6th P.M., located approximately 4 miles north of Carbondale at 2550 County Rd. 109. SITE DATA: The site consists of a 7.2 acre tract. WATER: Existing well SEWER: Existing and proposed individual sewage disposal system. ACCESS: Existing private drive. EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District D, Rural Areas with Moderate Environmental Constraints and District F, River/Floodplain Severe Environmental Constraints as designated on the Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County, with adjacent land uses agriculture, open space and gravel extraction. The Roaring Fork River borders the site on the east. Existing improvements include one single family residence. B. Project Description: The applicant proposes to construct a guest house on the site which would be located partially within the identified 100 Year Flood Plain on the site. The Garfield County Zoning Resolution requires Special Use permits for a guest house and for development within the 100 Year Flood Plain. III.MAJOR ISSUES AND CONCERNS 1. The Division of Water Resources has verified that the existing well, proposed to serve the two homes, is approved to serve up to three dwelling units. 2. The applicant's guest house proposals are in accordance with Section 5.03.025 of the Zoning Resolution requiring a 3 acre minimum lot size and limiting guest houses to a maximum of 1,000 sq. ft. of area to be uses for residential occupancy. • • Major Issues and Concerns (continued) 3. The Garfield County Flood Plain Regulations include stipulations that the carrying capacity of the affected watercourse be maintained, that all necessary permits be issued, and that the lowest floor, including basement, of any residential structure shall not be less than 1 ft. above the maximum elevation of the 100 Year Flood. 4. The Army Corps of Engineers have indicated that no Department of the Army permits are required. (See letter, page 7 5. The applicant has submitted a study completed by Wright Water Engineering, Inc. for the site, addressing offsite flooding effects, and design recommendations for the guest house site. The study concluded that the proposed site is located partially within the Flood Fringe, that the minimum elevation of the lowest floor should be 5954.0 feet and that "the effect of the proposed building site fill on the 100 Year Flood Plain is, in our opinion, diminimus and immeasurable on adjacent lands." (See pages J -.Ji IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That for the above stated and other reasons, the proposed Special Use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, of a Guest House Special Use permit and Flood Plain Special Use permit, with the following conditions: 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval, unless stated otherwise by the Board. 2. That the individual sewage disposal system for the guest house be constructed and floodproofed in accordance with Section 6.11.02(1)(F) of the Garfield County Flood Plain Regulations should it be located within the 100 Year Flood Plain. 3. That the applicant construct the guest house in accordance with the design and siting recommendations contained in the Wright Water Engineers, Inc. study. 4. The applicants shall have 120 days from the date of the Resolution of Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance unless construction or use has commenced. -2-
