The application is included in Appendix A. Four of the ten lots are proposed to allow foiaccessory dwelling units. This parcel of land, currently zoned,is A/R/RD, Agricultural / Residential / Rural Density, partially lies within New Castle's 3 mile area boundary and Silt's 2 mile sphere of influence. The Sketch Plan and Land Use Summary Map are included in Appendix B. The roughly triangular shaped parcel of land lies between County Road 335 (Colorado River Road) and the Colorado River, approximately 3 miles *.ri of Apple Tiee park and 3 miles east of thel-70 Silt Interchange, as shown on the Vicinity Map included in Appendix E. This parcel of land is located within the west half of Section 7, Township 6 South, Range 9l West, of the 6th p.M. The majority of the parcel is gently sloping, irrigated pasture land which lies approximately twenty-five vertical feet above the south bank of the Colorado River. The pasture land is irrigated with three parallel ditch laterals that traverse the site as shown on the aerial photograph included in the Appendix D. Two existing residential structures (and associated out-buildings) are located at opposite comers of the properry near County Road 335. Approximately 4 acres of the northern portion of tn. property, lies mostly within the Colorado River's 100-year flood plain urd i. moderateiy vegeiated with trees and brush. Presently there are no lakes or perennial streams on the property. However, the applicant is currently constructing two 0.4 acre ponds for irrigati,ol sto.agein the areas shown on the Land use Summary Map included in Appendix B. The proposed residential lots, ranging from 2.0 to 7.0 acres in size, are laid out and sizedin a manner where historic irrigation and drainage patterns can be maintained. The two existing residences will be subdivided as lots I & 6. Building envelopes for each of the 10 lots are sized and spaced with the intent of maintaining a rural atmbsphere that provides views, privacy and the passage of wildlife. Devilopment u-.riti.r, to be enjoyed by all the lot owners and their guests, include a private park located primarily within Colorado River flood plain and approximately +,000 of piivate pedestiian trail meandering throughout the development, primarily following the inigation ditch laterals and lot lines. The central *ut., supply system will consist of two wells, chlorination/treatment facilities, an undergrounil ^ storage tank, a pump station, and distribution lines. An existing well, which is currentlyproviding an adequate water supply for the two existing residences without the use of a storage tank, will be the primary water supply for the proposed water system. According to the well completion report included in Appendix F, thi rc-foot deep well was developed in January 1980. A24-hour pump test conducted in January ZO0l yielded a sustained pumping rate of 15 gallons per minute. A functional backup well wijt Ueincluded as part of the water system construction. The legal water supply for these wellsis currently contracted with the West Divide Water conservancy District's Substitute Supply Plan for l5 dwelling units (see Appendix G). The applicant will supply the County with detailed well testing data with the preliminaryplan application. 8 Page 4 of 8 Acce [Jnits: ll rl rl rl rl rl I T T I T T T t T T T currently, the property's irrigation water rights are one fifth of all those ditch rights inthe Goldman Ditch, Pump and Pipeline adjudicated in Civil Action No. 2759 in theGarfield County District Court for Water District No. 5 and in the Ward Reynolds DitchNo' l7 under Priority Nos. 32, 104 and, 166-0 as conveyed by deed recorded asReception No' 2941 17 inBook 528 atPage 296 of th. i..ord, of the Clerk and Recorderof Garfield County, Colorado; subject to the provisions of agreement recorded asReception No. 293355 in Book 52,5 atPages^qoo-qos of the-Garfield Counfy Records.copies of these documents are included in Appendix H. These irrigation water rights will be owned and maintained by the homeownersassociation' The irrigation ditches will remain in place and will be operated andmaintained within platted easements. Two 0'4 acre irrigation ponds, with an average depth of nine feet, are currently beingconstructed on proposed Lots 9 & 10 and will be iupplied by the above referencedirrigation ditch water. Replacement water for pond evaporation is currently contractedwith the West Divide Water conservancy District's Substitute Supply plan (copyincluded in the Appendix G). GA N TER D PR CTION A dry fire hydrant, [proposed to be] located at the end of Harvest Lane, will allow firetruck access year round to irrigation pond water. Using a conservative pond freezedepth of two feet would leave an average depth of seven feet of available water (morethan 550,000 gallons) for fire protection. Sewage disposal will be by individual sewage disposal systems, typically consisting ofseptic tanks and leach fields for each dwelling. Sizing and desig, irsyrt.ms will be inaccordance with Garfield County and ColoraJo State regulations in effect at the time ofconstruction' Conventional leach fields should be acceptable for all the proposed sitesbased on the following facts: ' Two existing permitted individual sewage disposal systems located at oppositeends of the.development appear to be functioning properly. Available utilities for the proposed development are summarized as follows: Individual lot owners will be responsible for the construction, operation andmaintenance of their individual sewage disposal systems. However, ISDS design andperformance standards in accordance with barfield county ISDS Regulations will beincluded in the protective covenants and will be enforceable by the homeowners,association. New buildings should be designed with provisions for properventilation should post construction testing indicate unacceptable radon gas levels. The proposedbuilding areas for the lots adjacent to the Colorado River will adheie to the County Page 6 of 8 I I I I I I I I I I I I I I t I I I I I T I I I t T I T T As shown on the Sketch Plan's topography, the ground surface of property slopesuniformly downward to the northweit, beginnin[ with grades of 8 to 12 percent atCounty Road 335 and gradually flattening outtJ2to 4 percent as the ground approachesthe steep bank of the Colorado River. Thi lack of any definite drainage channels acrossthis site (except the Colorado River - see above) indicates that only minor sheet flowdrainage is generated from the adjacent County Road and other properties. The lack of significant off-site runoff decreases the amount of grading and drainageinfrastructure necessary for roads and new building areas. Detention is not currentlyproposed for this development because of the large lot sizes that allow natural diffusionof minor flows generated from any proposed lot i--p.or.-ents. The added imperviousarea for each lot would be only a few pircent of the sites' total area. The diffuse flowswould be intercepted by one of the many ditch laterals traversing the sites. Also, anynew roadside drainage will be routed into the existing field irrigation ditch laterals. In general, erosion control should consist of disturbing as little existing vegetation aspossible and, therefore, minimizingreclamation. Minimal site grading is anticipatedother than the grading for the two roads. All disturbed areas will be seeded with a grassmix recommended by the Soil Conservation Service. floodplain and stream bank set back regulations. The layout of Gilead Gardens will maintain the most easterly access but eliminate theremaining two driveways that have poor sight distance. The two short roads proposedwill intersect county Road 335 near the crests of hills which will frovide acceptablesight distance in both directions. The roads will be constructed in 50-foot wide public rights-of-way and will be maintained by the homeowners association in accordance withGarfield Counfy Subdivision Rules and Regulations. other than the existing drivewayfor Lot 1, direct access onto county Road :Js witt not be permitted. THE SUBDIVISION PROCESS ln order to subdivide land in Garfield County, an Applicant is required to complete lhe following land useprocesses in the following order: 1) Sketch Plan Review Process, 2) Preliminaiy plan Review piocess, and3) Final Plat Review Process. This section will briefly describe the nature of each process and providegeneral direction including subdivision regulation citaiions to a potential applicant requesting subdivisionapproval in Garfield County. All of the Garfield County Zoning and Subdivision Regulations are located forpurchase at the Planning Department and can also oe found on the World Wide Web at the following address: http://wv/w,oarfield-countv.conribuitdinq and planninq/index.htrrl A) The Sketch Plan Review (section 3:00 of the Subdivision Regulations) 1. Puroose The purpose of the Sketch Plan process is to allow an individual an opportunity topropose a subdivision in a "sketch" format to the Planning Department and the GarheldCounty Planning Commission in order to obtain a cursory review for compliance withthe County's land use review documents, regulations, and policies to identify anyissues that would need to be addressed if the priposed subdivision were to Oe pursued 2. Applicability Any individual proposing a subdivision in Garfield County is required to complete theSketch Plan review process as the first step in Garfield iounty's Subdivision process.More specifically,. Garfield County defines a subdivision (Sectio n 2:2O.4gj as thedivision of a lot, tract or parcel oi land into two (2) or more lots, tracts, parcels orseparate interests, or the use of any parcel of land tor condominiums, apartments orother multiple-dwelling units, as further defined by colorado state law. S Agplication / Subm ln order -to apply for a Sketch Plan Review an Applicant is responsible for reviewingSection 3:00 of the Subdivision Regulations and providing enough information to thePlanning Department in the applica[ion to conduci a thoroiugh reii"w and provide theresulting comments to the Planning Commission for their review and comments.Specifically, Section 3:30, 3:32, and 3:40 of the Subdivision Regulations contain thespecific information required to be submitted to the Planning Oe"partment in order tosatisfy the application requirements in addition to the inforiration requested on thisapplication form. 4. Process / Public Meeting The Sketch Plan review process is considered a 1-step process because theapplication is reviewed only by the Planning Commission at a public meeting. !n orderto appear before the Planning Commission, an applicant will have submitted allrequired application submittal requirements mentioned above to the planning Department Staff- Once submitted, Staff will have 15 working days to review theapplication to determine if all the required submittal information has been submitted asrequired. lf Staff determines that all the required information has been submitted, a letter will besent to the applicant indicating the application has been deemed .technically complete." lt is at this point Staff will also indicate when the application has been 4 I I I I I I t I I T t I I I I I I I I T t T t T I T T T T T t scheduled to be reviewed before the Planning Commission and will request the applicant supply additional copies to provide the Commission for their review. lf Staff determines that all the required information has not been submitted, a letter willbe sent to the applicant indicating the application does not comply with the submittat requirements and therefore has determined the application to be "technically incomplete." The letter will also outline the applications deficiencies so that the applicant knows what additional information needs to be submitted. At this point, the applicant has 6 months (180 days) to provide the necessary information to the Planning Department to remedy the application so that it may be deemed technically complete. lf the application has not been deemed technically iomplete within this time, the application will be terminated. Once the application has been deemed technically complete and a date has been established as to when the Planning Cornmission will review the application, Staff will conduct a land use review of the application using the County's land use regulatory documents including the Zoning Resolution, Subdivision Regulations, anO th; Comprehensive Plan of 2000. ln addition, Staff will also considei referral commentsprovided from a variety of state and local agencies who may also review the application As a result, Staff will write a Memorandurn on the proposed subdivision to the'planning Commission containing the results on the land use analysis. This Memorandum will also be furnished in advance to the applicant. At the date and time set for the public meeting before the Planning Commission, Staffwill present the findings in the Memorandum and the applicant will be required topresent the proposed subdivision and respond to comments and questions provided bythe Planning Commission. The comments provided to the Applicant by the plannini Department and the Planning Commission as a result of the Sketch plin process wiilbe kept on file in the Planning Department for l-year from the meeting date before the Planning Commission. lf an Applicant does not suOmit a Preliminary eian application tothe Planning Department within the 1-year timeframe, the Sketth plan iile will beclosed and the Applicant will need to reapply for a Sketch Plan review prior to aPreliminary Plan review. B) Preliminary Plan Review (section 4:00 of the subdivision Regulations) 1. Puroose The purpose of the Preliminary Plan review process is to conduct a thorough review ofthe many aspects that are associated with dividing land in Garfield County for thepurposes of residential, commercial, and industrial development. This is ihe most intensive review step where the Building and Planning Staff, the planning Commission, and the Board of County Commissioners (BOCC) wili conduct a thorouglh review of allthe issues associated with the proposed subdivision against the Couity's regulatory requirements. Ultimately, the purpose of this process is to identify all the maloi issueiin the proposed subdivision by using the County's Zoning Resolution, SubdivisionRegulations, Comprehensive Plan of 2000, as well as other state and local referral agencies that will provide comments on any issues raised in their review. Applicabilitv Any individual proposing a subdivision in Garfield County is required to complete thePreliminary Plan review process as the second and most intensive step in GarfieldCounty's Subdivision process. More specifically, Garfield County defines a subdivision as the division of a lot, tract or parcel of land into two (2) or more lots, tracts, parcels orseparate interests,.or the use of any parcel of land foi condominiums, apartments orother multiple-dwelling units, as further defined by colorado state law. 3. Application / Submittal Requirements ln order to apply.for.a Preliminary Plan Review, an Applicant must have alreadycompleted the Sketch Plan review process addressed in Section 3:00 of theSubdivision Regulations. An .applicant requesting Preliminary Plan review will be required to submit thisapplication form, all the required submittal information contained in Sections 4:40 to4:94 of the Subdivision Regulations as well as address all of the applicable Desiqn andlmorovement Standards in section g:00 of the Subdivision Regulaiions. ln addition to the substantive submittal information related to the proposed subdivisionproject itself, an applicant is required to complete all the public notice requirements sothat legal public hearings can be held before the Planning Commission and the BOCCwhich is addressed in Sections 4:20 - 4:31of the subdivilion Regulations. 4. Process i Public Hearings The.. Preliminary Plan review process is considered a 2-step process because theapplication is ultimately,reviewed by two County decision-making entities during publichearings: the Planning Commissionwho makes a recommendation to the BOCC. ln order to obtain dates for the public hearings before the Ptanning Commission andthe BOCC' an applicant will have submitted all required ap[lication submittalrequirements mentioned above to the Planning Department Staff. Once submitted,Staff will have 30 working days to review the apflication to determine if all the requiredsubmittal information has been submitted as required. lf Staff determines that all the required information has been submitted, a letter will besent to the applicant indicating the application has been deemed "technically complete." lt is at this point Staff will also indicate when the application has beenscheduled to be reviewed before the Planning Commission / BOCC. Additionally, Staffwill provide the applicant with the notice formJto be mailed, published, and posted. lf Staff determines that all the required information has not been submitted, a letter willbe sent to the applicant indicating the application doeJnot comply with the submittalrequirements and therefore has determined the application io be ',technically incomplete." TheApplicant will first propose the subdivision to the Planning Commission who isresponsible for making a recommendation of approval, appr&al with conditions, ordenial to the BOCC. Next, the application will'be revLwed by the BOCC during a legular public hearing. The BOCC will consider the recommendations from thePlanning Staff and the Planning Commission, the information pr"i"nt"O by theapplicant, and the public. As a result, the BOCC is the final decision-making entityregard.ing the proposed subdivision and will either approve, approve with conditLn., o1.deny the application. tf. th9 BocG approves the subdivision application at the public hearing, the approvalshall be valid for a period not to exceed one (1)year from the date of goarO approval,or conditional approval, unless an extension oinot more than one tf l Veaiis'grantedby- the Board prior to the expiration of the period of approval. The letter will also outline the applications deficiencies so that theapplicant knows what additional information needs io be submitted. Once the application has been deemed technically complete and a date has beenestablished as to when the BOCC will review tfre r;nai plat, Staff will review theapplication / Final Plat in terms of adequacy to determine if all the submittal informationsatisfies the Final plat requirements as well as the responses to the conditions ofapproval. During this review, Staff will fonryard the Final Plat the County Surveyor forreview an! a signature. ln the event there are additional questions or clarificationissues to be addresse.d, the County Surveyor will generally c-ontact the afplicant tohave the plat adjusted as necessaiy. Mup unit: 65 Torrifluvents, nearly level Description Category: SOI This broadly defined unit consists of deep, well-drained to somewhat poorly drained soils on flood plains. The soils formed in alluvium. These soils are stratified and vary widely in texture and depth. The surface layer ranges from loamy sand and fine s andy loam to silty loam and clay loam. The underlying layers are generally sandy loam or loam stratified with sand, gravel, and cobbles. The watertable fluctuates between depths of 2 and 4 feet and insome years is near the surface during spring runoff. These soils are subject to brief, occasional flooding late in spring and early in summer. Permeability is moderately slow to moderately rapid. Available water capacity is low to high.
