INTRODUCTION
The applicant, David & Renee Miller, is proposing to subdivide their 35 acre parcel of
land into eight residential lots. As shown on the Sketch Plan in Exhibit A, the triangle
shaped property is located between County Road 335 and the Colorado River,
approximately 3 miles west of Apple Tree Park. The parcel of land is a portion of the
West Half of Section 7, Township 6 South, Range 91 West, of the 6e P.M (complete
property description shown in Title Commitment, Schedule A in Exhibit B).
The majority of the parcel lies approximately 30 feet in elevation above the Colorado
River as irrigated pasture. Along the northern boundary, approximately 4 acres of the
property lies within the Colorado River's 100 yr flood plain andaportion of it is
heavily vegetated with trees and brush. There are two existing residential sfructures
(and associated out-buildings), one located near the east corner and the other
southwest corner of the properly. These homes will occupy two lots (1 & 5) of the
eight proposed lots. In order to preserve the lot views and a majority of pasture land,
the center portion of the property will be maintained as pasture. This will be
accomplished on our preliminary plan by designating building envelopes around the
development's perimeter. Lot sizes range from 3 to 6 acres.
There are no lakes or perennial sfieams within the project. Site impacts will be
minimal with the addition of six new homes. Road cuVfill slopes will be small due to
the existing gentle ground slope. All disturbed areas will be smoothed and re-
vegetated with a native grass seed mixttne.
The property is currently zoned A/RIRD, Agricultural/Residential/Rural Density, and
no change in zoning is requested. As shown on the Assessor's map in Exhibit C, the
proposed layout blends in well with the adjacent properties

PHASING
The project is not proposed to be phased
WATER SUPPLY SYSTEM
The Subdivision's domestic water needs will be served by either an individual well for
each dwelling unit, or by a lesser number of wells wrth appropriate well sharing
agreements. Currently, there is one existing well (approximate location shown on
sketch plan in Appendix A) provrding an adequate water supply to the two existing
residences. According to the well completion report included in Appendix E, the 76
foot deep well was developed in January 1980 and yielded 20 GPM for a one hour
period. The appticant will supply the County with more current well testing data with
the preliminary plan application.
Additional wells will be drilled to provide potable water for the new lots within the
proposed subdivision. Representatives of the applicant have conferred with the West
Divide Water Conservancy District and have confirmed that the property is within
Area A approved in the existing West Divide Water Conservancy Dstrict's Substitute
Supply Plan. The applicant will enter into an appropriate contract with the West
Divide Water Conservancy District to provide a legal supply of water to the proposed
wells and will operate under the District's established Substitute Supply Plan until
completion of any necessary augmentation case. The applicant shall have the
appropriate West Divide Water Conservancy District contract in place prior to
approval of preliminary plan.

Currently, the property's irrigation water rights are one fifth of all those waste and
ditch rights in the Goldman Ditch, Pump and Pipeline adjudicated in Civil Action No
2759 in the Garfield County District Court for water District No. 5 and in the Ward
Reynolds Ditch No. l7 under Priority Nos. 32,104 and 166-0 as conveyed by deed
recorded as Reception No. 294117 nBook 528 atPage 296 of the records of the
Clerk and Recorder of Garfield County, Colorado; subject to the provisions of
agreement recorded as Reception No. 293355 in Book 525 atPages 906-908 of the
Garfield County Records. Copies of these documents are included in appendix F.
These irrigation water rights will be divided between the lots based on the existing
irrigated areas. The irrigation ditches will remain in place and willbe operated and
maintained by a twenty foot wide easement. fuI irrigation water agreement for the
lots will be created and recorded in the Garfield County Clerk and Recorder's office.
WASTEWATER TREATMENT
Sewage disposal will be by individual sewage disposal systems, typically septic tanks
and leach fields for each dwelling. Sizing and design of systems will be in accordance
with Garfield County and Colorado State regulations in effect at the time of
construction. W'ith two perrnitted individual sewage disposal systems apparently
operating properly and the SCS soils infonnation, ttrere are sfiong indications that the
additionat sites will have acceptable percolation rates for conventional soil absorption
systems. The two permits are included in appendix G & H.
Responsibility for construction, operation and maintenance of individual sewage
disposal systems in accordance with Garfield County Health Departrnent regulations
will rest with the individual lot owners, who will maintain the systems.
UTILITIES
Utilities are already available to the site including elecfiicity from Holy Cross Elecfric
and telephone service from US West Communications. Extensions can easily be
made to service each proposed lot. Natural gas and cable TV are not available at this
time. As mentioned above, domestic water will be provided from on-site wells, and
sewage treafinent will be through individual sewage disposal systems.

RADIATION HAZARDS
According to tIP Geotech's letter report included in Appendix I, the project site does
not appear to be on geologic deposits with high concentrations of radioactive
materials. However, since there may be radon gas potential in the area,the letter
recornmends that testing of gas levels should be completed shortly after the
completion of building construction. New buildings should be designed with
provisions for proper ventilation should post construction testing indicate
unacceptable gas levels.
COLORADO RIVER FLOOD PLAIN
The Colorado River runs along the property's norlhern edge as shown on the attached
Sketch Plan. The river's 100 year flood plain elevations are approximately 25 to 30
feet below the rivers steep southerly bank as indicated on the sketch plan. The
proposed building areas for the lots adjacent to the Colorado River will be required to
adhere to the County's river set back regulations to prevent additional bank erosion or
slides. Copies of the Corps of Engineers' Flood Plain Study maps for this areaare
included in Appendix J.
DRAINAGE
As shown on the Sketch Plan's topography, the propetty's ground surface slopes
unifonnly downward to the northwest, beginning with gtades of 8 to 12 percent at
County Road 335 and gradually flattening out to 3 to 6 percent as the ground
approaches the Colorado River's steep southerly bank. The lack of any definite
drainage channels across this site (except the Colorado River - see above) indicates
that only minor sheet flow drainage is generated from the adjacent County Road and
other properties.
The lack of significant off-site runoffdecreases the amount of grading and drainage
infrastructure necessary for roads and new building areas. Detention is not currently
proposed for this development because of the large lot sizes allowing natural diffirsion
of minor flows generated from proposed lot improvernents. The added impervious
area for each lot would be only a few percent of the sites' total area. The diffirse
flows would make routing of flow to detention areas difficult and the consfruction of
channels and ponds would disfurb more area and cause more erosion than warranted
by any benefit gained. However, any new roadside drainage will be routed into the
existing field irrigation ditch structures.

In general, erosion control should consist of disturbing as little existing vegetation as
possible and, therefore, minimizing reclamation. The areas that must be disturbed will
be seeded with a grass mix recommended by the Soil Conservation Service.
ACCESS AI\D ROADS
The property's exiting two dwelling units and pasture currently have three accesses
onto County Road 335. The most easterly access serving lot I will be relocated to
allow for a new road for lots 3,4,6,7, and 8. The new 22 foot wide gravel road with
2' shoulders, approximately 800 feet in length, will be constructed in a 50 foot wide
easement in accordance with Garfield County Subdivision Rules and Regulations. In
an effort to minimize drainage, erosion, and dust impacts and preserve more of the
pasture land and views, a variance will be requested for an 800 foot road with Cul-de-
sac. This will be reviewed with County staffand local fire disffict officials prior to
Preliminary Plan application.
SOIL CONSERVATION SERVICE MAPPING
Soil desiguation mapping, interpretations and aerial photos were obtained from the
Soil Conservation Service office and are included in Appendixes J & K.

Map unit: i Arvada loam, 1 to 6 percent slopes
Description Category: SOI
This deep, well-drained soil is on fans and high terraces. This soil formed in highly
saline alluvium derived from sandstone and shale. The surface layer is strongly
alkaline or very strongly alkaline loam about 3 inches thick. The subsoil is silty clay
loam about '14 inches thick. The substratum is silty clay loam to a depth of 60 inches.
Permeability is very slow, and available water capacity is moderate. Effective rooting
depth is 60 inches or more. Runoff is medium, and the erosion hazard is moder
ate.
Map unit: 40 Kim loam, 3 to 6 percent slopes
Description Category: SOI
This deep, well-drained soil is on alluvial fans and benches. This soil formed in
alluvium derived from shale and sandstone. The surface layer is loam about 17 inches
thick. The underlying material is loam to a depth of 60 inches. Permeability is moder
ate, and available water capacity is high. Effective rooting depth is 60 inches or more.
Runoff is slow, and the erosion hazard is moderate.
Map unit: 56 Potts loam, 6 to 12 percent slopes

Map unit: 58 Potts-Ildefonso complex, 12 to 25 percent slopes
Description Category: SOI
These soils are on mesas and sides of valleys. The Potts soil formed in alluvium
derived from sandstone, shale, or basalt. The lldefonso soil formed in very strongly
calcareous, basaltic alluvium and small amounts of eolian material. Potts soil makes up
about 60 percent of the map unit, and the lldefonso soil makes up about 30 percent.
Potts soil is deep and well-drained. The surface is loam about 4 inches thick. The
subsoil is clay loam about 24 inches thick. The substratum is loam to a depth of 60
inches. Permeability is moderate, and available water capacity is high. Effective ro
oting depth is 60 inches or more. Runoff is rapid, and the erosion hazard is high.
lldefonso soil is deep and well drained. The surface layer is stony loam about 8 inches
thick. The urderlying material is very strongly calcareous very stony loam to a depth of
60 inches. Permeability is moderately rapid, and available water capacity is
low. Effective rooting depth is more than 60 inches. Runoff is rapid, and the erosion
hazard is high.
Map unit: 65 Tomifluvents, nearly level
DescriptionCategory: SOI
This broadly defined unit consists of deep, well-drained to somewhat poorly drained
soils on flood plains. The soils formed in alluvium. These soils are siratified and vary
widely in texture and depth. The surface layer ranges from loamy sand and fine s
andy loam to_silty loam and clay loam. The underlying layers are generally sandy loam
or loam stratified with sand, gravel, and cobbles. The water table fluctuates between
depths of 2 and 4 feet and in some years is near the surface during spring runoff.
These soils are subject to brief, occasional flooding late in spring and early in
summer. Permeability is moderately slow to moderately rapid. Available w-ater
capacity is low to high. Effective rooting depth is 60 inches or more. Runoff is slow,
and
the hazard of water erosion is slight.
