RE Release of Re-veqetation Securitv - Gilead Commons Subdivision
The County is holding $6,569.39 (as cash) in an account to guarantee re-vegeiation
within the Gilead Garlens Subdivision. Gilead Gardens is located on the south side of
the Colorado River between New Castle and Silt.
County Vegetation Manager Steve Anthony has verified the success of the re-vegetation
and, aL such, the Board is requested to sign the attached security release'

ACKNOWLEDGMENT OF' SATISFACTION AND DIRECTION TO TREASURER
TREASURER'S DEPOSIT AGREEMENT
GILEAD GARDENS _ RE.VEGETATION SECURITY
Recitals
1. BBD TRUST, [a Colorado Trust] and David and Renee Miller [Trustees]
entered into a Treasuter's Deposit Agreement with the Board of County Commissioners of
Garfield Cotrnty, Colorado ("BOCC") and the Treasurer of Garfield County, Colorado
("Treasurer") dated September 14,2007 and recorded as Reception Number 733197 of the ReaI
Estate Records of the Garfield County Clerk and Recorder ( "Deposit Agreement").
2. To serve as a re-vegetation security, BBD TRUST provided Garfield County
with a check dated August 8,2007 for $6,423.60 (Alpine Baxk Cashier Check No. 316027). As
of October 21,2009, resulting from interest payments, the amount in the account was $6,569.39.
3. On September 29,2009 Garfreld County Vegetation Manager Steve Anthony
visited the site, approved the re-vegetation efforts, and recommended the release of the security.
Acknowledgement
NOW THEREFORE, at the request of BBD TRUST
and in consideration of the premises and the prior agreements contained in the Deposit
Agreement and the SIA, the BOCC hereby:
l. acknowledges full satisfaction of the re-vegetation security requirements of the SIA;
2. authorizes disbursement of funds from the 'Gilead Gardens Reveg'
Treasurer's Account in the amount of $$6,569.39 plus interest, resulting in a remaining balance
of$-0-
3. authorizes and directs the Treasurer to release the funds held in the
Treasurer's Account to an authorized representative of BBD TRUST.

During a site visit on $eptember 29,2009, the Garfreld County Vegetation Depafiment inspected the revegetation wotk done at the
Gilead Gardeus subdivision located south of Nerv Castle off of County Road 335.
The Garfield Courty Vegetation Management Depaftment approves the release of the revegetation security, John Niervoehner,

RE Release of Financial Securitv - Gilead Gardens Subdivision. Givil
lmprovements
Gilead Gardens is an approved 8-lot subdivision located between Silt and New Castle on
the south side of the Colorado River.
The County is holding a $14,630 cash security to guarantee the installation of
infrastructure improvements. Per documentation provided by BBD TRUST (the
developer) and their engineers, all infrastructure improvements are complete. As such,
BBD TRUST is requesting the release of the security. The County continues to retain a
separate security to guarantee re-vegetation.
The County Staff recommends that the BOCC approve the release of the $14,630
security to BBD TRUST.

Recitals
1. BBD TRUST, [a Colorado Trust] I entered into a 2009 Garfield County
Treasurer's Deposit Agreement with the Board of County Commissioners of Garfield County,
Colorado ("BOCC") and the Treasurer of Garfield County, Colorado ("Treasurer") dated
September 14r 2007 and recorded as Reception Number 733198 of the Real Estate Records of
the Garfield County Clerk and Recorder ('oDeposit Agreement").
2. BBD TRUST has presented certification to the BOCC from a licensed engineer
that construction of Improvements is final in accordance with the Subdivision Improvements
Agreement between the BOCC and BBD TRUST, recorded as Reception Number 733194.

NOW THEREFORE, at the request of BBD TRUST
and in consideration of the premises and the prior agreements contained in the Deposit
Agreement and the SlA, the BOCC hereby:

I have conducted a site review of the remaining work to be completed for the above
referenced project. I believe to the best of my knowledge and numerous field visits
conducted during project construction, that the improvements as summarized on the
attached referenced "Exhibit "A" Gilead Gardens Engineers Estimated Cost for
Infrastructure" dated 7-17-09, are complete in accordance with the intent of the plans and
specifications and Garfield County regulations. The total amount of remaining work is
$0 reduced from the previous outstanding balance of $14,630.
Record as-built drawings for the Subdivision's potable water and inigation systems are
attached.
