No. 139 for one cubic foot of water per second of time, which

Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as
amended, and Sections 2.02.01(d) and 3.02.01 of the Subdivision
Regulations of Garfield County, Colorado, adopted January 2, 1979,
as amended, the undersigned Eugene C. Laven, Norma E. Laven,
Charles A. Beck and Mona E. Beck respectfully petition the Board
of County Commissioners of Garfield County, Colorado to exempt by
resolution the division of a tract of land containing approximately
1.38 acres (said tract being described on Exhibit "A" attached
hereto and depicted as Parcel A on the exemption map submitted
herewith) from that adjoining tract of land owned by Becks, which
tract of land will contain in excess of 35 acres upon completion
of the division herein requested, for the purpose of adjusting
the boundary line between said Beck property and property owned
by Lavens as described on the attached exemption map, and' to there-
upon exempt by resolution, the division of the Laven property
(including parcel A as above described) into two tracts of
approximately 2.01 and 2.02 acres respectfully (said tracts being
described on Exhibit "A" and depicted as parcels C & D on the
attached exemption map) from the definitions of "subdivision" and
"subdivided land" as the terms are used and defined in C.R.S. (1973),
Section 30-28-101 (a) -(d) and the Garfield County Subdivision
regulations, and further exempting from said definitions the divi-
sion of parcel B as described on Exhibit "A" and depicted on the
attached exemption map, to allow for the conveyance of said par-
cel B to Larry A. Kindall and Bernice Kindall for addition of the
same to the Kindalls adjoining property. In support of this
petition, it is hereby stated:
1. The conveyance of parcel A from Becks to Lavens is
for the purpose of adjusting property lines, with said parcel
A to become part of Lavens existing property.
2. The requested division, together with any earlier
divisions of the Beck property permitted under circumstances not
defined above, will create no more than 3 tracts under 35 acres in
size and the balance of the Beck property is in access of 35
acres in size.
3. Parcels C & D to be created by exemption, will meet all
requirements of the applicable zone district, which allows a
minimum lot size of two acres.
4. The exemption of parcel B and its conveyance to Kindalls,
will not create any new parcels and will conform the legal descrip-
tion of Lavens property to the legal description of Kindalls as
depicted on the attached exemption map.
