County Attorney , Clerk of the Board day of RESOLUTION No .81-364` A'RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR CHARLES AND MONA BECK.. WHEREAS, Charles and Mona Beck have petitioned the Board of County Commissioners of Garfield County,' Colorado,for an exemption from -the definitionof the terms "subdivision" and "subdivided land " under C.R.S. 1973,30-28-101 (10) (a) -(d), as amended, and the. Subdivision Regulations. of Garfield County, Colorado, adopted 'January 2, 1979, Sections 2.02.21 (d), and 3.02.01 for the division of an approximately 320 acre tract described as follows: that tract of land as:described .in.Document No 220330 as filed in th Office of the Clerk and Recorder of Garfield County, Colorado into;2tracts of approximately 1.38 and 318.62 acres each, more or less, which proposed divided tracts are more particularly described as follows:: TRACT A A parcel -of land situated in Tract 37 and Government Lot 15, Section 17, Township 7 South, Range 88 West of the Sixth Principal Meridian, Garfield County Colorado, more particularly described as follows: Beginning at Angle Point #6 of said. Tract #37, a brass cap monument in place; thence S.39°59'43"E.`294.52-feet to a point on the northerly right-of-way line of County Road #113, the True Point of Beginning; thenceleaving said northerly right-of-way line N.12°11'00'W. 35.30 feet; thence N.51°45'34"E.437.58 feet; thence N.12°11'00"W. 196.75 feet; thence S.71°29'00"W..123.00 feet; thence N.18°31'00"W. 73:04 feet; thence::'. 5.71°29'00"E,: 298.20 feet; thence S.18°30'54"E. 73.04 feet; thence:S.13°57'17"E. ._136.97 feet to a point on the northerly right-of-way line of Cc my Road #113, thence along said northerly right-of-way line the following courses and distances; S.51°21'16"W. 342.75 feet; thence S.46°05'30"W. 169.58 feet; thence S.49°31`49"W. 136.71 feet to the True Point of Beginning, containing 1.38 acres, more or less. TRACT B: The.remaining approximately 319 acres. (in the State of Colorado and County of Garfield).; and WHEREAS,. the Petitioners have demonstrated to _the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the property split is solely for the purpose of adjusting property boundaries, and no new lots are created, and WHEREAS, the Petitioners have demonstrated to -the satisfactionof the Board of County Commissioners of Garfield County, Colorado,that there is a reasonable probability -of locating domestic water on each said tracts, that there is adequate ingress and egress to said.tracts, that' the location of septic tanks will be permitted:by the Colorado Department of -Health that the requested division is not part of an existing or larger development and does not fall within.the general purposes and intent of the subdivision regulations of the State of Colorado and_the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land".as set forth in the C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; BQOK 5ST fi!G€9 NOW; ThEREFORE, BE IT RESOLVED that the division of the above described tracts ".", "IP; 2from`the above described 320. acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A", "B" all as is more fully described above,; and said divided tract may be conveyed in the form of such smaller tracts'. without further compliance with the aforesaid subdiv±sion statutes and regulations, provided, however', that this exemption is luanted on the condition and with the express unders andingand agreement of the Petitioners that no further exemptions be allowed on said tracts "A" and that a copy of the instrument or instruments of conveyance whenrecorded shall be filed with this Resolution.
