Reception No. 249456 Mildred Alsdorf, Recorder,._ BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION NO. 78 /O 4- WHEREAS,- James Layne, by and through his authorized agent, Elmer Blackmore, has petitioned the Board of County Commissioners of Garfield.... County, Colorado, for an exemption from the definition of the terms "sub- division" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of an 8 acre tract into two tracts of approxi- mately 1.66 acres (hereinafter tract "A") and 6.33 acres (hereinafter tract "B" more or less, and said 8 acre tract is more particularly described as follows: A parcel of land situated in Lot 6 of Section 16, Township 6 South, Range 93 West of the Sixth Principal Meridian, lying Westerly of the Westerly line of an alley and Southerly of the Southerly right-of-way line of project I-70-1 (12) section 4, said parcel of land is described as follows: Beginning at a point on the Westerly line of said alley, whence. the South 4 Corner of said Section 16 bears: S.07°38'53" E. 1077.84 feet; thence N.89°54'00" W. 100.00 feet; thence N.08°55'00" W. 98.17 feet to a point on the Southerly right- of-way line of said I-70; thence N.75°10'35" E. along said right-of-way line. 99.29 feet to a point on the Westerly line of said alley; thence S.08°55'00" E. along the Westerly line of said alley, 124.07 feet to the point of beginning. The above described parcel of land contains 0.25 acres, more or less. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of resale of said tract "A" to Harold Elmer Blackmore for use in conjunction an adjoining tract owned by Harold Blackmore, and further that no third party ownership shall be created by this division, and; WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the requested division is in accordance with the general purposes and intent of the Sub- division Regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d) as ..and carried,::said'8.acre::of land`_ is: hereby Richard C.
