HomeMy WebLinkAbout2.0 Resolution 77-101• • RESOLUTION -0.11-/_^/ WHEREAS, JAMES LAYNE, has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S.(1973) Section 30-28- 101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 11.26 acre tract into two tracts of and et9. Lz6, more or less, and said 11.26 acre tract is more particularly described as follows: Section 16: A tract of land in SW lying N. of I-70 ROW and E. of I-70 Rest Area ROW cont. 11.26 ac. Beg. at a point on N. ROW of I-70 whence the Sn cor. of Sec. 16 bears S. 50° 40' 30" E. 1887.6' thence N. 140 11' E. 105.8' thence N. 19° 21' E. 400.1' thence N. 1° 11' E. 129.4' thence N. 880 11' E. 81.3' thence N. 89° 28' E. 285.44' Thence S. 890 40' E. 322.1' thence E. 330' thence N. 380' thence E. 110' to Co.Rd. 320, thence S. 80 10' E. along Co.Rd. to a point 175' N. 8° 10' W. from the N. ROW line if I-70 thence W. 24.7' thence S. 290 45' W. to N. ROW of I-70 thence S. 690 28' W. along ROW to P.O.B. TOTAL11.26 Ac. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioner has demonstrated to .the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and therefore, be exempted from the definition of the terms "subdivision"and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of P 6ve4,1_ ( !. seconded by rv.f Liee6SIce7 from such definition and transfer of said tract may be made by division into two tracts of c7Z and ?,edacres, all as is more fully described above, and further that said exemption is conditioned upon the Petitioner obtaining a proper legal description of said tracts prior to conveyance thereof.
