(1973) Section 30-28-101(10)(a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution more fully hereinafter described, from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. MURPHY, whose address is 642 33-3/4 Road, No. A, Clifton, Colorado, referred to in this contract as Seller, and RAYMOND E. LEECH and SHARA L. LEECH, as joint tenants, whose address is Box 1334, Rifle, Colorado, referred to in this contract as Purchasers. In consideration of the promises and agreements herein contained, the parties agree as follows: 1. Seller is the owner of a tract of land described in a certain warranty deed recorded January 4,A1971, as document 248584, situate in Section 36, Tp. 5 S., R. 93 W. of the 6th P.M., Garfield County, Colorado. The Purchasers are the owners of a tract of land containing .89 acres located in Section 36, Tp. 5 S., R. 93 W., of the 6th P.M., described as follows; Begintl:ing 1334 feet North of the East Quarter Corner of said Section 36, thence North 239.25 feet along said Ran&e line, thence 305.25 feet Westerly, thence South 14 25' E. for a distance of 305.25 feet, thence North 70°20' E. along the North line of Rifle Creek Road 221 feet to the point of beginning. 2. Sale. The Seller agrees to sell and the Purchasers agree to purchase a strip of land 50 feet by 239.25 feet, adjoining and lying directly Easterly of the Purchasers' property described above.
