Pursuant to C.R.S. (1913) Section 30-28-101 (10) (a) -(d) as amended, and
th-e Subdivision Regulations of Garfield County, Coloradp, adopted September 1, •
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01, miXtlxX

respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 25.14 acre tract of
land into two tracts of approximately 18.8 and 6.34 acres each,

All that portion of SEaSE; of Section 4, Township 6 South, Range 92 West of the
6th Principal Meridian, lying Northerly of the Lower Cactus Valley Ditch (Grand
River Ditch), Westerly of County Road No. 231 and Southerly of County Road No.
236, with the exception of those parcels of land as described'in Document Numbers
212291, 186210., and 216256 of the Garfield County records.
from the definitions of "subdivision" and "subdivision land" as the terns are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below:

Exhibit "A"
It is the desire of the Petitioner to convey to Paul W. Black
the following tract out of the above-described property owned by
said Petitioner:
A parcel of land situated in the SE; SEa of
Section 4, Township 6 South, Range 92 West of
the Sixth Principal Meridian lying Southerly
of the Southerly line of County Road No. 236;
Westerly of the Westerly line of County Road
No. 231; Northerly and Westerly of those
parcels of land as described on Document
Numbers 216256, 186210 and 212291 as recorded
in the Clerk and Recorders office, Garfield
County Colorado; and Easterly of a fence as
constructed and in place more particularly
described as follows:
Beginning at the section corner common to
Sections 3, 4, 9 and 10, Township 6 South,
Range 92 West of the Sixth Principal Meridian,
said corner located near the intersection of
1st Street and Grand Avenue to the town of
Silt, Colorado; thence N 49°49'50" W 444.75
feet to the True Point of Beginning, said
point being on that line as described by
metes and bounds on Documents No. 186210 and
No. 177883; thence leaving said line and
alongside a fence as constructed and in place
N 00°43'16" W 999.22 feet to a point on the
Southerly right-of-way line of County Road
No. 236; thence along said Southerly right-
of-way line S 89°30'24" E 310.00 feet to a
point on the Westerly right-of-way line of
County Road No. 231; thence along said West-
erly right-of-way line S 00°31'04" E 746.00
feet to a point on the Northerly line of
Document No. 216256; thence along said Northerly
line S 89°22'00" W 50.00 feet; thence alongside
a fence S 00°49'00" E 100.81 feet to a point
on the Northerly line of Document No. 186210
and No. 212291; thence along said Northerly
line N 89°22'00" W 138.77 feet; thence along-
side a fence S 00°37'10" E 192.56 feet to
that line as described on Document No. 177883
and No. 186210; thence along said line N
59°07'00" W 34.38 feet; thence N 74°51'00" W
92.64 feet to the True Point of Beginning.
Said parcel of land contains 6.34 acres more
or less.
There is reserved a 17.5 foot strip of ground
lying Northerly and adjoining that line as
described on Document No. 177883 and No.
186210.
This tract will be adequately served by existing roads and
presents no problem related to the intensive use of land or

provision of utilities and surfaces and is not part of an existing
or larger land development project. In support of this contention,
the Petitioner states as follows:
1. The 6.34 acre tract has been historically utilized
separate and apart from the rest of the property. The separation
is physical due to the existence of a fence along the proposed
line of division. The separation is also historical: the larger
parcel is basically the one conveyed by the Petitioner in 1959 to
Keith Terrell and subsequently re -acquired by the Petitioner in
1965; the smaller tract was not transferred in either of these
conveyances.
2. Already located on the smaller piece of property are old
house and a barn -like main building. This parcel has been used
to support one single-family residence in the past and no more
intensive use is anticipated by the new owners.
3. Access to the parcel to be conveyed is readily available
due to the fact that said parcel is immediately adjacent to
County Roads Number 231 and 236.
4. The water source for the above-described premises will
be an established domestic well, and sewage disposal will be
handled by a septic tank and leaching field arrangement.
