BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17(d) and 3.02.01, the undersigned Paul
and Bertha Lindstrom respectfully petition The Board of County
Commissioners of Garfield County, Colorado, to exempt by
resolution a tract of land of 124 acres, more or less, principally
located in the SWa of Sec. 24, T. 5 S., R. 91 W., 6th P.M.,
more fully hereinafter described in Exhibit "A", from the
definitions of "subdivision" and "subdivision land" as the
terms are used and defined in C.R.S. (1973) Section 30-28-
101(a) - (d) and the Garfield County Subdivison Regulations,
for the reasons stated below:

1. Petitioners desire to sell a parcel of 10 acres, more
or less, on which petitioners operate a campground, to a
new owner who will continue to operate the campground on
that acreage. No change in use is contemplated. The
legal description of the parcel which petitioners wish to
sell is set out in Exhibit "B" and a plat of that portion
is attached as Exhibit "C". Exhibit "D" shows the parcel
to be sold in relation to the total acreage owned.
2. Access to both the parcel sold and the parcel retained
will be available via County Road No. 241.
3. The campground is presently served by its own water
and sewer system. This system meets the requirements of
the Colorado Department of Public Health and the County
Environmental Health Department. The change in ownership
will not generate any change in the water and sewer
requirements of the parcel sold or the parcel retained.

Legal description of 124.03 acres, more or less, owned by
Petitioners:
The E1/2SW4 and the SW4SW4 of Section 24, Township 5 South,
Range 91 West of the Sixth Principal Meridian, containing 120
acres, more or less.
A parcel of land situated in the SE4NW4 of Section 24, Township
5 South, Range 91 West of the Sixth Principal Meridian, lying
Westerly of the Westerly right of way line of a county road as
constructed and in place, and Northerly of the Southerly line
of said SE4NW4, said parcel of land being described as follows:
Beginning at a point on the Southerly line of said
SE4NW4 said point being on the Westerly right of way line
of said road; whence the Southeast Corner of said SE4NW4
being the same as the center of said Section 24 bears N.
89°14'12" E. 209.40 feet; thence S. 89°14'12" W. 546.19
feet along the Southerly line of said SE4NW4; thence N.
45°00'00" E. 785.81 feet to a fence as constructed and in
place; thence S. 22°05'33" E. 260.40 feet along said
fence to a point in the center of said East Elk Creek;
thence N. 61°33'00" E. 98.85 feet along the center of
said creek to a point on the Westerly right of way line
of said road; thence 95.97 feet along the arc of a curve
to the right, having a radius of 147.01 feet, the chord
of which bears S. 40°03'43" W. 103.82 feet; thence 187.52
feet along the arc of a curve to the left, having a
radius of 232.32 feet, the chord of which bears S.
37°36'55" W. 182.47 feet; thence 141.33 feet along the
