WHEREAS, PAUL and BERTHA LINDSTROM have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C. R. S.
(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended
April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 124
acre tract into two tracts of 10 and 114 acres, more or less and said 10
acre tract is more particularly described as follows:
A parcel of land situated in the SE.INW4 and the NEQSWa
of Section 24, Township 5 South, Ranae 91 West of the
Sixth Principal Meridian, County of Garfield, State of
Colorado, said parcel of land is described as follows:
Beginning at the center of said Section 24, as monumented;
thence S. 000 11' 17" E. 618.50 feet along the North-
South Centerline of said Section 24; thence N. 800 36'
50" W. 198.60 feet; thence N. 780 57' 25" W. 348.91 feet
to a point in a ditch as constructed and in place;
thence along said ditch N. 310 32' 40" E. 62.50 feet;
thence N. 020 10' 16" W. 88.17 feet; thence N. 210 37'
41" W. 38.22 feet; thence N. 040 42' 04" W. 111.56 feet;
thence N. 060 51' 01" W. 54.50 feet; thence N. 180 11'
36" W. 149.51 feet; thence N. 04° 37' 32" E. 26.77
feet, more or less, to a point on the East-West Center-
line of said Section 24; thence S. 89° 14' 12" W.
174.24 feet along said centerlin; thence N. 450 00'
00" E. 785.81 feet; thence 5. 22w 05' 33" E. 260.40
feet to a point in the center of East Elk Creek;
thence N. 610 33' 00" E. along the center of said creek,
98.85 feet to a point on the Westerly right-of-way
line of County Road No. 241; thence 95.97 feet along
the arc of a curve to the right, having a radius of
147.01 feet, the chord of which bears: S. 420 02' 12"
W. 94.26 feet; thence 187.52 feet along the arc of a
curve to the left, having a radius of 232.32 feet, the
chord of which bears: S. 370 36' 55" W. 182.37 feet;
thence 141.33 feet along the arc of a curve t0 the left,
having a radius of 633.11 feet the chord of which bears:
S. 08 05' 47" W. 141.04 feet, more or less, to a point
on the East-West Centerline of said Section 24; thence
N. 89° 14' 12" E. along said centerline, 209.40 feet,
more or less to the center of said Section 24, the point
of beginning, containing 11.00 acres, more or less.
Excepting therefrom a strip of land 60 feet in width
situated in the NE'4SW4 of Section 24, being County Road
No. 241, said road described as follows, being 30 feet
in width on each side of the following described
centerline:
Beginning at a point in the center of said county road
said point being in the Fict-U— r `'n+er1ine of said
Section 24 whence the center of said Section 24 as
monumented bears: N. 89° 14' 12" E. 209.40 feet;
thence along the centerline of said County Road No.
241, 1.29 feet along the arc of a curve to the left,
having a radius of 603.11 feet, the chord of which
bears: 5. 010 46' 30" W. 1.29 feet; thence 99.81 feet
along the arc of a curve to the left, having a radius
of 662.87 feet, the chord of which bears: S. 020 36'
45" E. 99.72 feet; thence S. 060 55' 34" E. 123.26
feet; thence 146.15 feet along the arc of a curve to
the right, having a radius of 263.94 feet, the chord
of which bears: S. 080 56' 13' W. 144.29 feet; thence
S. 24° 48' 00" W. 151.37 feet; thence 69.92 feet along
the arc of a curve to the left, having a radius of
376.71 feet, the chord of which bears: S. 190 29' 01"
E. 69.81 feet to a point on the Southerly line of the
above described parcel of land, leaving a total of
10.18 acres, more or less.
The above described parcel of land is subject to Ditches
as shown on the attached map.
WHEREAS, the Petitioner have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that they desire
said exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the
State of Colorado and the County of Garfield and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set
forth in C. R. S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of .e _�/Ir cf seconded by
eC'L-i5C_ and carried, said 124 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by division
into 2 tracts of 114 and 10 acres, more or less, all as is more fully described
above. A copy of the instrument(s) of conveyance when recorded shall be filed
with this Resolution.
