Consulting Engineers November 3,2004 Board of County Commissioners Garfield County 108 8th Street Glenwood Springs, CO 81601 RE: Gilead Gardens Preliminary Plan Time Extension Request Dear Board of Commissioners: I hereby formally request a time extension of the Gilead Gardens Preliminary Plan resolution No. 2003-89. I was at fault and inadvertently recognized the Recording Date of the Resolution November 3,2004 as the one year deadline date for filing Final Plat or a time extension, instead of the actual September 15,2003 Commission hearing date. However, I believe it would be a great waste of County and other review agencies time and resources to go through the Sketch and Preliminary Plan review process again since the Project's proposed density and design plans will remain unchanged. WATER:Central Water System SEWER:Individual Sewage Disposal Systems (ISDS) ACCESS:County Road 335 I. BACKGROUND As you will recall, on September 15, 2003,the Board approved the Preliminary Plan for the Gilead Gardens Subdivision which entailed subdividing approximately 35 acres of land into 9 residential lots. This approval was memonalized in Resolution 2003 - 89. This approval provided the Applicant I year from the date of Board approval to file a Final Plat application with Garfield County. This deadline was Septernber 15,2004 and no such application was filed with the County. As a result, the Preliminary Plan approval has expired. II. REQUEST The Applicant missed the deadline to file the Final Plat and requests the Board approve al-year extension to file. (See the letter attached to this memo from the Applicant's representative explaining the reasoning for the request.) III. STAFF COMMENT Section 4:34 of the Subdivision Regulations states that "Preliminary Plan approval shall be valid for a period not to exceed one (1) year from the date of Board approval, or conditional approval, unless an extension of not more than one (1) year is granted by the Board prior to the expiration of the period of approval. The Applicant made no such request within the time frame contemplated in the Subdivision Regulations. Section 4:34 does not provide the Board with regulatory direction in the event an extension has not been granted. The Applicant is now in a position where they must resubmit a Preliminary Plan.
