Lappala and virginia Lappala have petitioned the Board of County Corunissioners of Garfield county, colorado, for an exemption pursuant to c.R.s. L973, 30-28-101 (10) (d) and the Subdivision Regulations of Garfield County, Colorado, adopted I September, L972, Sections 1.02.17(d) and.3.02.01, for the exemption of a tract of land containing 10.05 acres, more or less, out of the Nw 1rl4 NW 1/4, Section 2'1 , Township 7 South, Range 88 West of the 6th P'M', more partj-cu1arly described as follows: A tract of land contained in the Nw 1/4 NW 1/4 of Section 27, Tovrnshj.p 7 South, Ranqe 88 ?Iest of the 6th P.l{., more particularly described' as follows: Beginning at a point on the West line of said SecLion 27-whenc6 the N6rthwest corner of said Section 27 bears N. OOo06'54" w. 513.59 feet; thence S' 73o19'56" E' 825,94 feet to a point on the Westefly rlgh!.of way of the Couniy-noaa; Lh"rr.. S. 31o41'54" w. 85.64 feet along the West"ify right of way of the County foSd; thence S. 34o34,14n W.-374.89 feet along said right of way; thence along the arc of a curve to the left on said right of-*iy, which arc subtends a chord of S. 25"35r09" W. gO.S7 fei:t,; thence S. 18036'O4r'W. 66.09 feet along said riqht of way; thence along the arc of a curve to th"e rigfrt on sai& right of way, which arc subtends a chord bearing S. 25"i6'29" W. 47.64 feet to a point on said West6rly right of way of the County Road.; thence West 449-.82 ieet to a point on the West line of Section 27, Township 7 Soulh, Range 88 West-of the 6th p.M.; thence N. 00;06'54" W. 805:11 feet along 91iq_- Section iirr" to the point of beginning, containing 10.058 acres, more or less. WHEREAS, the petitioners have shown to the satisfactior' of the Board of County Conunissioners of Garfield County, Colorado, that they desire such exemption for the PurPoses of resale of said tract for single family residential purposes, and WHERSAS, there is adequate ingress and egress to the tract, there is no reason why the Colorado Department of Hea1th will not permit an aPProPriate septic system to be installed on the tract, an electric power line is situated so as to provide power to the tract, and a purchaser of the tract would obtain domestic water for use on the tract by means of a weLl, which is in keeping with the manner of water supply on adjacent tracts, and irr"t arr" requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield., and should therefore be exempted from the definition of the terms "subdi.vision" and "subdivided land" as set forth in C.R.S. L973, 30-28-101 (10) (d). NOW, THEREFORE, uPon motion of I'laven'Cerise seconded by Pete Mattivi , and unanimouslY carried, the tract hereinabove described is hereby exempted from such d.efinitions and the transfer of the tract may be mad.e separately by conveyance, all as more fulIy described in the Petition pertaining hereto. A copy of the instrument of conveyance when executed and recorded shall be filed with this resolution. Dated this 2Tthday of May, !975, at Glenwood Springs, Colorado.
