A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTTON FROMSUBDIVISION REGULATIONS FOR PAUL AND VTRGINIA LAPPALA.
THE GARFIELD COUNTY
WHEREAS, Paul anq.virginia Lappala have petitioned the Board of Countyloyni. sioners of Garfield Countyr-bolorado, tor an exemption from thedefinition of the terms "subdivision" and "subdivided land,, under c.R.S.1973, 30-28-I01 (I0) (a)-(d), as amended, and the Subdivision ne!uiationsof Garfield county, colorado, adopted January z, Lg|g, sections 2.o2.zL(d) and 3.02-0I for the division of a 30.97 acre tract described asfollows: that parcel of lano as described in Book 436, page 4Og, as filedin the office of the clerk and Recorder of Garfield county, cororado, into2 l'acts of approximatery 18.58 acres and L2.3g acres each, more or less,wnich rproposed divided tracts are more particularly-described in theattached Exhibit A.
WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of County Commissioners of Garfield County, Colorado, that theproposed division does not fall within the purp6""" of part I, Article 2g,Title 30, colorado Revised statutes lg73r ErS amended , for the reason thattne impact created doe.s not warrant further subdivision review, and
WHEREAS, tte Petitioners have demonstrated to the satisfaction of thetsoard of county commissioners of Garfield county, colorado, that there isa reasonable probability of locating domestic t it.r on each of saidr-racts, that there is adequate ingress and egress to said tracts,tnat the location_of septic tanks will be permitted by the coloradoDepartment of Hearth, that the requested division is not part of anexisting or larger development and does not fall within ti.,e g"nerirpurposes and intent of the subdivision regulations of the State ofCol-orado and the county of Garfierd, and ihould, therefore, be exemptedfrom the definition of the terms "subdivision,,and =uoaivided land,,as setforth in C.R.S. 1973 , 30-29-IOI (IO) (a)_ (d) , as amended;
Now THEREFORE, BE IT RESOLVED that the division of the above describeoparcels one and Two from the above oescribed 30.9i u.r" tract is herebyexempted from such definitions and said tract may be diviaed-into-'purcelscne and Two, arr as is more fully described anov6, and said divided tractmay 9g conveyed in the form of such smatler tracts without furthercompliance with the aforesaio subdivision statutes and regulations;
