BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 79-62

WHEREAS, Robert and Helen Laffoon have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the defini-
tion of the terms "subdivision" and "subdivided land" under C.R.S. 1973,
30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and
3.02.01 for the division of a 9.34 acre tract described as follows: A parcel
located within Lots 39 and 42, Sec. 4 T6S, R92W of the 6th P.M., Garfield
County, Colorado, and being more particularly described as follows:
Beginning at the NE corner of said Lot 39; thence South along the center of a
lane 600.00 feet to a point which is approximately the center of a gulch
bottom; thence along said gulch bottom with the following courses: (S70°
W. 83.00 feet; thence S30°W 146.00 feet; thence N75°W 100.00 feet; thence
N80°W. 88.00 feet; thence S45°W. 147.00 feet; thence S67°W 57.00 feet; thence
S47°W 81.02 feet); thence North 894.02 feet, more or less, to the north line
of said Lot 39; thence N89°53'E along said north line 549.92 feet to the
POINT OF BEGINNING; and containing 9.34 acres more or less into 2 tracts of
approximately 5.34 and 4.00 acres each, more or less, which proposed divided
tract is more particularly described as follows:
Tract A: A parcel located within Lot 39 of Sec. 4, T6S, R92W of the
6th P.M., Garfield County, Colorado, and being more particularly
described as follows:
Commencing at the NE corner of said Lot 39 (said corner being a
railroad spike set in the intersection of two lanes); thence
S89°53'W along the north line of said Lot 39 (with all bearings in
this description being relative to the line between said NE corner
Lot 39 and the W4 corner of said Sec. 4, said W4 corner being a
railroad spike set in the intersection of two lanes, being called
S89°53'W) 269.92 feet to the TRUE POINT OF BEGINNING; thence S89°53'W
continuing along the north line of said Lot 39 280.00 feet; thence
S00°00'E 622.29 feet; thence N89°53'E 280.00 feet; thence N00°00' E
622.29 feet to the POINT OF BEGINNING; and containing 4.00 acres,
more or less.

WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that the proposed
division does not fall within the purposes of Part 1, Article 28, Title 30,
Colorado Revised Statutes 1973, as amended, for the reason that the impact
created is not large enough to proceed through full subdivisic,ri review; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is a
reasonable probability of locating domestic water on each of said tracts,
that there is adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department of Health, that
the requested division is not part of an existing or larger development and
does not fall within the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and should,
therefore, be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as
amended;
NOW, THEREFORE, upon the motion of R.C. Jolley , seconded by
Larry Velasquez , and carried, the division of the above described
tract "A" from the above described 9.34 acre tract is hereby exempted from
such definitions and said tract may be divided into tract "A", all as is more
fully described above, and said divided tract may be conveyed in the form of
such smaller tracts without further compliance with the aforesaid subdivision
statutes and regulations; provided, however, that this exemption is granted
on the condition and with the express understanding and agreement of the
Petitioners that no further exemptions be allowed on said tract "A", and that
a copy of the instrument or instruments of conveyance when recorded shall be
filed with this Resolution.
