HomeMy WebLinkAbout1.0 ApplicationBEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972, and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned DON L. LYNCH and CHRISTINE G. LYNCH respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution a tract of 5.13 acres into two tracts of 3.13 acres and 2.0 acres more or less, more fully hereinafter described: N1/2NE4 Section 22, Township 7 South Range 89 West of the 6th P.M., Garfield County, lying Westerly of a County Road as constructed and in place described as follows. Beginning at a point on the Westerly line of said road whence the NE corner of said Section 22 bears N. 89°04'39" E. 1268.06 feet; thence S. 22°27'26" E. 95.95 feet along the Westerly line of said road; thence S. 47°47'01" E. 142.83 feet along the Westerly line of said road; thence S. 23°03'28" E. 145.25 feet along the Westerly line of said road; thence S. 21°52'14" W. 229.34 feet; thence S. 01°46'01" E. 295.78 feet; thence N. 28°46'37" W. 348.88 feet; thence N. 30°54'37" W. 130.71 feet; thence N. 58°54'37" W. 130.71 feet; thence N. 38°40'37" W. 135.40 feet; thence N. 76°21'23" E 400.70 feet to a point on the Westerly line of said road, the point of beg- inning. Containing 5.1+ acres more or less. 3 From the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations, for the reasons stated below: That the petitioners desire to split property leaving the existing home with the 2.0 acre tract, and selling the 3.13 acre tract. There are now two good springs on the tract, located at opposite ends of the property. One spring now provides water for the existing house and garden. The southerly spring could provide plenty of water for a home and the 3.13 acre tract. Ingress and egress can be provided from county road 117 to each of the above tracts.
