HomeMy WebLinkAbout2.0 Resolution 77-52RESOLUTION 1.A7-7-5-2.- WHEREAS, 77-S2- WHEREAS, DON L. and CHRISTINE J. LYNCH, have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 5.13 acre tract of land into two tracts of approximately 2 acres and 3.13 acres, more or less, and more particularly described as follows: NUIE14 Section 22, Township 7 South, Range 89 West of the 6th P.M., Garfield County, lying Westerly of a County Road as constructed and in place described as follows: Beginning at a point on the Westerly line of said road whence the NE corner of said Section 22 bears N. 89° 04' 39" E. 1268.06 feet; thence S. 22° 27' 26" E. 95.95 feet along the Westerly line of said road; thence S. 470 47' 01" E. 142.83 feet along the Westerly line of said road; thence S. 23o 03' 28" E. 145.25 feet along the Westerly line of said road; thence S. 210 52' 14" W. 229.34 feet; thence S. 01° 46' 01" E. 295.78 feet; thence N. 28° 46' 37" W. 348.88 feet; thence N. 30° 54' 37" W. 130.71 feet; thence N. 58° 54' 37" W. 130.71 feet; thence N. 380 40' 37" W. 135.40 feet; thence N. 76° 21' 23" E. 400.70 feet to a point on the Westerly line of said road, the point of beginning. Containing 5.13 acres,more or less. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage, and; WHEREAS, said 3.13 acre parcel does have sufficient area for building lying out of the 100 year floodplain of Four -Mile Creek; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended; NODI THEREFORE, upon, motion of a.i�`�-f tJ 7 seconded by , and carried, said 5.13 acre tract of land is hereby exempted from such definition and transfer of tract may be made by division into two tracts of 2 and 3.13 acres, more or less, and further, that a proper legal description be prepared for said tracts prior to their conveyance. A copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this ie)` day of June, A.D. 1977.
