Beattie, has petitioned the Boand of County Commissiono:s of Ganfield County: Colonado, for an exemption fnom the definition of the tenms "subdivisionrr and "subdivided landrr unden C.R.S. 1973 30-28-101(10) (a)-(d) as amended, and the Subdivision Regulations of Garfiel-d County, Colorado adopted Septemben L, 7972 and amended Apnil 14, 1975, Sections 1.02.t7(d) and 3.02.01, fon the division of a 3100 acne tnact into two (2) tracts of approximately 3.0 acnes heneinafter tract trAt'and 3097.0 acnes heneinafter tract t'Brr, more ol3 Iess, and said tnact rrBrr is mone particulanly descnibed as follows: A pancel of land situated in Lot 11, Range 88 West of the Sixth Pnincipal of the southwesterly night-of-way of a fence as consfnucted and in place follows: ion 29, Township 6 South, Mer , lying southwesterly 115, eastenly ofCounty more Pa ulanly described as Beginning at the East kcorner of Section 29, Township 6 South, Range 83 West of the Sixth Principal Menidj.an, an iron post with a bnass cap attaehed proper.'Iy ma::ked and set by the Garfield County Sunveyon thence N33o14t46" w, 1457.52 feet to a point in a fenie the true point of beginning; thence alongside said fence No4v20r26'r I.I, 374.95 feet; thence leaving said fence N82o5Or31ri B, 308.78 feet to a poi.nt on the southwes'terIy right-of-way lin.e of Ccr.rnty P..oad 115; thence along said night-of-way line along the anc of a cunve to fihe left 151.46 with a nadius of 395.65 and which the chord beans S37"13t11tr E, 150.54 feet; thence leaving said night-of-way S05oO3t54'r E, 193.64 feet to a point in an existi-ng fence; thence leaving said fence S75o32t19r' Wr 398.78 feet to the True Point of Beginning. Said parcel of land contains 3.00 acnes, more on less. IIHEREAS, the Petitionen has demonstnated to the satisfaction of the Boand of County Commissioners of Garfield County, Colorado, that he desires said exemption fon the purpose of increasing the size of a previously subdivided lot f-r'om five ( 5) to eiglrt (B) acnes'by sale of the newly cneated three (3) acne lot to the owner of the five (5) acre parcel, ed ftrther that no thind panty ownership sha1l be cneated by this division; and, WHEREAS, the Petitionen has demonstnated to the satisfaction of the Board of County Commissionens of Ganfiefd County, Colonado, that the neguested division is in accordance with the genenal punposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted fnom the definition of the terrns "subdivisiontt and "subdivided landrr as set forth in C.R.S. 79?3 30-28-101(10)(a)-(d), as amended; and, NOW, THEREFORE, upon the nrotion of Flaven J. Cenise, seconded by Richard C. Jolley, and carried, said 3100 acre tract of land is treneby exempted from such lI 2 definition and said tnact Tay be divided into two (2) tnacts of 3'0 and 3097'0 acres, more or less, aII as is mcre fully described above, and said divided tract may be conveyed in the fonm of such smallen tnacts without further complaince with the aforesaid subdivision statutes and negulations; pnovided however, that said exemption is conditioned on the Petitionen obtaining a proPen Iega1 descniption of said tracts pnion to any conveyance thereof. .Fu::ther:, this exemption is granted on the condition that no further exemptions be all-owed on said combined five (5) and three (3) acre tracts, either combined on separately.
