RESOLUTION
WHEREAS, RICHARD LOONEY has petitioned the Board of County Commissioners of
Garfield County, Colorado, for an exemption under CRS (1973) Section 30-28-101
(10)(a) -(d) as amended, and the Subdivision Regulations of Garfield County, •
Colorado, adopted Septeiber 1, 1972 and amended April 14, 1975, Sections 1.02.17
(d) and 3.02.01, for th

WHEREAS, the Peti[tioners have shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpo7 of re -sale into single-family residential acreage,
and,

WHEREAS, Petitioner has demonstrated to the satisfaction of the Board that
there is a reasonable probability of locating domestic water on each of said
14 and 49 acre tracts, that there is adequate ingress and egress to said tracts,
that the location of septic tanks will be permitted by the Colorado Department
of Health, that the requested division is in accordance with the general purposes
and intent of the subdivision regulations of the State of Colorado and the County
of Garfield and that said division will actually restrict the density of housing
within said area and should therefore, be exempted from the definition of the
terms "subdivision" and "subdivided land" as set forth in CRS (1973) Section
30-28-101 (10) (a) - (d)- as amended;
WHEREAS, petitioner will provide access to the newly created lot by
granting a deeded easement for the purposes of access to said lot, and furthermore,
will survey said lots and prepare an adequate legal description prior to
conveyance of any property; G'-/Vra!:1),
NOW THEREFORE, upon motion of seconded by,.N,t.`,,i��y�
and unanimously carried said 63 acre tract of land is hereby exempted from
such definition and transfer of said tract may be made by division into two (2)
tracts of 14 and 49 acres, more or less, all as is more fully described in the
Petition pertaining hereto. A copy of the instrument or instruments of conveyance
when recorded shall be filed with this Resolution.
