A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THEDEFINITION OF'SUBDTVISION IN TIIE GARFIELD COUNTY SUBDIVISION
REGULATIONS F'OR A PROPERTY OWNED BY KEIYNETII AND MARILYIILATIIAM LOCATED IN THE NW % OF TIIE II-W % AND SW Y4 OF TIIE NW %,
SECTION 11, TOWNSHIP 6 SOUTII, RANGE 93 WEST OF THE 6O P. M. ANDCoMMONLY LOCATED AT 1985 COUNTY ROAD 293, RIFLE, COLORADO
WHEREAS, Kenneth and Marilyn petitioned the Board of County Commissioners ofGarfield County, Colorado, for an exemption from the definition of the terms ,,subdivision,, and
"subdivided land" under C.R.S. 1973,30-28-101 (10) (a)-(d), as amended, and the Subdivision
Regulations of Garfield County Colorado, adopted April 23, 1984, Section 8:00 through g:60 and forthe division of a 59.94-acre tract into t'wo (4) tracts morepractically described as follows and
contained in Exhibit A:
Lot t having 33,72 acres
Lot 2 having 6.62 acres
Lot 3 having 8.00 acres
Lot 4 having 11.60 acres
WHEREAS, the property is located within the Agricultural/ Residential / Rural Density(ARRD) zone district and is also located in Study Area2 oith. Comprehensive plan of 2000 in an
area designated as "outlying residential,,; and
WHEREAS, Section 8:52(A) of the Subdivisionregulations of 1984, as amended, states that
"No more than a total of four (4) lots, parcels, interests ortweling units will be created from any
parcel, as that parcel was described in the records of the Garfield County Clerk and Recorder's Office
on January 1,7973, and is not a part of a recorded subdivision; however, any parcel to be divided byexemption that is split by a public right-of-way (State or Federal highway, bi"rry road or railroad)or natural feature, preventing joint use of the proposed tracts, and the division occurs along thepublic righrof-way-or natural feature, such parceis thereby created may, in the discretion of theBoard, not be considered to have been created by.*"*ption with regard to the four (4) lot, parcel,

wrrEREAS, the Board of County Commissioners of Garfield County, colorado, on thebasis of substantial competent evidence produced at the aforementioned hearing, has made thefoliowing determination of facts, ^

2' The hearing before the Board of county commissioners was extensive and complete, allpertinent facts, matters and issues wergsubmitted, and all interested parties were heard atthat meeting;

4' The application is in conformance with theapplicable provisions in the Garfield counfySubdivision Regulations of 19g4, as amendud; *a

3 ' Prior to the signing of a plat, the Appljcant shall provide proof to the Building and planningDepartment that a well test for the *L[ to serve Lot z whicrr demonstrates an adequate pump
' rate and water quality pursuant to subset a - g below. If the aforementioned proof is notsubmitted, the Applicant shall be required to cinduct a well pump test that demonstrate thefollowing points:
a' That a four (4) hour pump test be performed on the well to be used;b' A well completion report demonstiating the depth of the well, the characteristics oftheaquifer and the static water level; '--- .'---'
c' The results of the four (4) hour pump test indicating the pumping rate in gallons perminute and information showing orawoown and r..i*g.';

d' A written opinion of the p"rroi, conducting iie *"tt test that this well should beadequate to supply water to the number of prlposed lots;e' An assumption of an average of no less than 3.s p.opir po dwelling unit, using 100galions of water per person, per day;f' If the well is to be shared, a l"gai,,well sharing declaration which discusses alleasements and costs associated with the operation and maintenance of the system andwho will be responsible for paying these costs and how assessments will be made forthese costs;g' The water quality be tested. by an independent testing laboratory and meet Stateguidelines concerning bacteria and nitrates.h' For water supplies based on the use of cistem, the tank shall be a minimum of 1000gallons.

a) No further divisions by exemption from the rules of subdivision will be allowed.
b) No open health^sol-id-fuel fireplaces will be allowed anywhere withjn an exemption. one(1) new solid-fuer burning stov" as defied by c.R.S. z5-7-40r, et. sew., and theregulations promulgated thereunder, will be allowed in any dwelling unit. All dwellingunits will be allowed an unrestricted number of natural gas burning stoves andappliances.

c) All exterior lighting willbe the minimum amount necessary and all exterior lighting willbe directed inward and downward, towards the interior of the subdivision, except thatprovisions may be made to allow for safety lighting that goes beyond the propertyboundaries -o
d) Foundations and Individual Sewage Disposal Systems shall be engineered by aProfessional Registered Engineer within thi state of colorado.
e) colorado is a "Right-to-Farm" State pursuant to c.R.s. 35-3-101, et seq. Landowners,residents and visitors must be prepared to accept the activities, sights, sounds and smellsof Garfield County's agricultural operations as a normal and necessary aspect of living ina County with a strong rural character and a healthy ranching sector. All must beprepared to encounter noises, odor, rights, mud, dust, smoke chemicals, machinery onpublic roads, livestock on public roads, storage and disposal of manure, and theapplication by spraying or otherwise of chemical Ertilizers, soil arnendments, herbicideqand pesticides, any one or more of which may nafurally occur as a part of a legal andnon-negligent agricultural operations.
0 All or'vners of land, whether ranch or residence, have obligations under State law andcountv regulations with regard to the maintenanc. "ii;;; il;;iln ditches,conkolling weeds, keeping livestock and pets under control, using prope.ti in accordancewith zoning, and other aspects of using and maintaining property. Residents andlandowners are encourag"d to learn aboit these rights and responsibilities and act asgood neighbors and citizens of the County. g) one (1) dog will be allowed for each residential unit within a subdivision and the dogshall be required to be confined within the ownerbprof"rty boundaries.
h) The-mineral rights associated with this property (also known as parcels L, z, 3,and 4 ofthe Latham Exemption) have been partiatty severed and are not fully intact or transferredwith the surface estate therefore atlowing ihe potentiaiior natural resource extraction onthe property by the mineral estate owner(s) oi lessee(s).
i) vegetation should be removed from near any structures in order to provide a safe zone inthe event of a wild land fire.
i) When conskucting access roadways, roads should be a minimum of 20 feet in width andconsideration is to be given to the weight of fire apppratus and accessibility duringadverse weather conditions.
k) Addresses are to be posted where the shared driveway intersects with the county road as

well as where the individual driveways intersect with the shared driveway. Letters are tobe a minimum of 4 inches in height and 1 inch in width and in contrast with backgroundcolors.
5' The Applicant shall address the following vegetation management issues with the countyVegetation Manager prior to final plat:
a' InveRtolv,aqd m4pping: T\ Anglicant shall map and inventory the property forGarfield county Listed Noxious-'fueeds. There may be Russian oiirr., tamarisk, andRussian knapweed on the property.
b' weed Managernent: The Applicant shall provide a weed management plan for theinventoried noxious weeds. The county is particularly concerned about noxiousweeds found on irrigation ditch banks.
c' covenants: Because weed management for the Association and each individual lotowner is not addressed in the covenants. The Applicant shall add wording in thecovenants that mentions the responsibility of landtwnerr t" ;;;;e county ListedNoxiousWeeds according to the Colorado Stut. Noxious Weed Act and the GarfieldCounty Weed Management plan.
