GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT
AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COUNTY (hereinafter COUNTY) and Andrew and Elizabeth Macdonald
(hereinafter APPLICANT) agree as follows:
1. APPLICANT has submitted to COUNTY an application for Old Macdonald Subdivision
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision plan.

property and that of Karen Kean -Hines, as well as an original Affidavit Re: Boundary Line
Adjustment, which were recorded on August 25, 2003 at Reception No. 634914, Book 1510, Page
313 and at Reception No. 634915, Book 1510, Page 316, respectively. You should retain these
original documents with your other important papers.
Also enclosed is a copy of the Land Conveyance Map prepared by Scarrow & Walker,
which shows the new boundary lines and provides a description of the parcel conveyed by the Quit
Claim Deed.

AFFIDAVIT RE: BOUNDARY LINE ADJUSTMENT
The undersigned affiant, being first sworn, deposes and states as follows:
1. I represent that Andrew John MacDonald and Elizabeth Butera MacDonald, grantees
in the Quit Claim Deed recorded herewith, are the owners of a parcel of land situate
in unincorporated Garfield County as is more fully described in that certain Deed
recorded in the office of the Garfield County Clerk and Recorder's Office at
Reception No. 475636, Book 934, page 562, which land adjoins and abuts certain
property owned by Karen Kean -Hines.
2. I represent that Andrew John MacDonald and Elizabeth Butera MacDonald and
Karen Kean -Hines are desirous of adjusting the boundary lines of their respective lots
in accordance with the Garfield County Subdivision Regulations of 1984.
3. I represent that the purpose of the conveyance of the property described on Exhibit
A hereto from Karen Kean -Hines to Andrew John MacDonald and Elizabeth Butera
MacDonald is to correct and clarify the boundary ofthe two properties, and that the
property conveyed in the Quit Claim Deed recorded herewith shall be merged with
the property of Andrew John MacDonald and Elizabeth Butera MacDonald as more
fully described in that certain Deed recorded in the office ofthe Garfield County Clerk
and Recorder's Office at Reception No. 475636, Book 934, page 562.
4. I represent that no new lots will be created and, therefore, that Garfield County will
not be required to issue any building permits, other than what it would be required to
issue for the already existing lots.
5. I hereby represent that none of the parcels of property involved in this boundary line
adjustment is part of a previously platted subdivision of record.
6. I hereby represent that the boundary line adjustment made reference to herein will not
cause the loss of access by road or to utilities, to any parcel of property involved.
7. I hereby represent that a copy of this Affidavit will be recorded with the Garfield
County Clerk and Recorder.

That the Grantor, for and in consideration of Ten Dollars and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, has remised,
released, sold, conveyed and QUIT CLAIMED, and by these presents does remise, release, sell,
convey and QUITCLAIM unto the Grantee, its successors and assigns, forever, all the right, title,
interest, claim and demand which the Grantor has in and to the real property, together with
improvements, if any, situate, lying and being in the County of Garfield and State of Colorado,

To HAVE AND TO HOLD the same, together with all its appurtenances and privileges, and

PROVIDED, HOWEVER, that the Property hereby conveyed shall be restricted to agricultural
uses, fences, open space and the like, and that no structure other than a fence or fences shall be
constructed upon the Property. This covenant shall run with the land, in perpetuity.

RE: Old Macdonald Subdivision, Sketch Plan
Dear Fred:
I have reviewed the sketch plan submittal for the proposed Old Macdonald Subdivision. I would
offer the following comments.
Access to the property is adequate of County Road 162.
Water supplies for fire protection will be limited to water carried by responding fire apparatus.
The new lot created by the subdivision is subject to development impact fees adopted by the
District. The developer will be required to enter into an agreement with the District for the
payment of development impact fees. This payment is due prior to the recording of the final
plat. Fees are based upon the per lot impact fee adopted by the District at the time the agreement
is executed. The current impact fee is $437 per lot.

Map unit: 34 Empedrado loam, 2 to 6 percent slopes
Description Category: SOI
This deep, well -drained soil is on terraces, fans and hills. The surface layer is loam 5
inches thick. The subsoil is clay loam 35 inches thick. The substratum to a depth of 60
inches or more is clay loam. Permeability is moderate. Available water cap
acity is high. Effective rooting depth is 60 inches or more. Runoff is medium, and the
hazard of water erosion is slight to high.
Map unit: 95 Showalter-Morval complex, 15 to 25 percent slopes
Description Category: SOI
This map unit is on alluvial fans, high terraces, and valley sides. This unit is 45 percent
Showalter very stony loam and 35 percent Morval loam.
The Showalter soil is deep and well -drained. It formed in alluvium derived dominantly
from basalt. The surface is covered with 10 to 15 percent stones, 5 percent cobble,
and 5 percent gravel. The surface layer is very stony loam 8 inches thick. The upp
er 3 inches of the subsoil is very cobbly clay loam. The lower 28 inches of the subsoil
is very cobbly clay. The substratum to a depth of 60 inches or more is very cobbly clay
loam. Permeability is slow. Available water capacity is moderate. Effective
rooting depth is 60 inches or more. Runoff is rapid, and the hazard of water erosion is
high to very high.
The Morval soil is deep and well -drained. It formed in alluvium derived dominantly from
basalt. The surface layer is loam 7 inches thick. The upper 12 inches of the subsoil is
clay loam. The lower 4 inches is loam. The substratum to a depth of 60 inch
es or more is loam. Permeability is moderate. Available water capacity is moderate.
Effective rooting depth is 60 inches or more. Runoff is rapid, and the hazard of water
erosion is very high.
