HomeMy WebLinkAbout1.0 ApplicationBEFORE T}IE BOARD OF COUNTY COMMISSIONERS OF GARFTELD CoUNTY, CoLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. 106-2^33 (3) (d) (1963), as amended, the undersigned, Charl-es E. Li.ndamood and Shirley Lindamood, respectfully petition the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of a Lract of land described on Exhibit lrArr attached hereto, containing LL.49 acres, more or l-ess, from the tract of land described on Exhibit rrBrr attached hereto, contalning 35 acres 'more or 1ess, and for the reasons set forth herein. 1. Petitioners are the owners of a tract of land in the S![k NEt of Section 17, Township 7 South, Range 88 tr'Iest, more f u11y described in attached Exhibit rrBrr. The tract described in attached Exhibit rrArt is a part of the larger tract and lies entirely southerl-y of the County Road #113. 2. Petitioners intend to convey the IL.49 acre parcel to a qualified buyer for use as a residential site, its highest and best use. Inasmuch as there are several homes in the area with adequate we11s, it would appear that domestic ldater supply is available. The Garfield County Department of Environmental Health has issued a letter of feasibility of sewage disposal system for said 11"49 acre tract. This 11.49 acre tract includes approximately 365' of County Road frontager therefore ingress and egress is readil-y aval1ab1e. Electricity and telephone lines are on the property' The three properties east of this tract are singl-e family residences, each on five (5) acres; this exemPtion would permit a residehce that would conform and would actual-1y restrict the density of housing in the atea' This 11.49 acre tract incl-udes at l-east one suitable building site, easily accessible from the county Road. 3. A copy of the deed of conveyance will- be f iled wlth the Petition and the Resolution if the exemption is granted.
