Extension to file an Exemption Plat for the
Tamburello North Exemption from the
Definition of Subdivision
APPLICANT: Gregory J. and Anne E. Tamburello

PROPERTY LOCATION: Along CR 210, in the Cactus Valley area, east of
Rifle, Colorado. A tract of land situated in
Section 2, Township 6 South, Range 93 West of
the 6`b P.M.
I. BACKGROUND:
The Board of County Commissioners approved the Tamburello North Exemption from the Definition of
Subdivision on November 4, 2002. This approval effectively subdivided 40 acres of land into 3 lots:
Tract 1 having 20.271, Tract 2 having 9.169 acres, and Tract 3 having 9.947 acres. The approval for the
Exemption required the Applicant to satisfy all the conditions of approval and present a plat to the Board
for signature within 120 days of the approval which expired on March 4, 2003.
The Applicant submitted the request for Extension to the Building and Planning Department on February
24, 2003. Since there was no regular Board meeting on March 3, 2003, the request for extension is
beyond expiration date (March 4, 2003) to satisfy all the conditions of approval and present that plat to the
Board. However, since the Applicant submitted the extension request prior to the expiration date, staff is
of the opinion that the Board should consider this extension request.
II. REQUEST:
The Applicant requests that the Board grant an extension until May 6, 2003, in order to complete the
conditions of approval for the Exemption. (Please see letter attached as Exhibit A). In the past, it has
been the practice of the Board to grant 1 -year extensions for Applicants who have received an approval for
an Exemption from the Definition of Subdivision to complete conditions of approval. Since the Applicant
is only requesting a two month extension, it is staff's opinion that the Board should consider an extension
until August 4, 2003, to allow the Applicant additional time just in case of any unforeseen circumstances.
III. STAFF RECOMMENDATION:
Staff recommends the Board grant an extension for the Tamburello North Exemption from the Definition
of Subdivision until August 4, 2003.

Enclosed please find a request for a time extension in order to complete the
Tamburello North exemption. Staff recommends the applicant be granted a 30 day time
extension (until 4/27/01). This will allow the Tamburellos time to wrap up the details of
their exemption.

The Tamburello North Exemption Request was given preliminary approval by the
County Commissioners on 11/27/00, which approval required submission of the Final
Exemption Plat by 3/27/01. Due to delays in getting the water well drilled and tested,
surveying delays, due to weather, and delay in getting the dry hydrant installed, also due to
weather constraints, Applicants request that the deadline for submission of the Final
Exemption Plat be extended one month, to April 30, 2001.
Please advise if you need any additional information or need me or my clients to
appear before the County Commissioners in support of this request.
