BEFORE THE BOARD OF COUNTY COI4MISSIONERS OF
- GARFIELD COUNTY, COLORADO
RESOLUTION NO. 79 - 8
WHEREAS, David Hotchkiss and Sydney Lincicome have petitioned
the Board of county commissjoners of Garfield county, colorado,
for an exemption from the definition of the terms "subdivision,'and
"subd'ivjded land" under C.R.S. .l973,30-28-l0l (.I0) (a)-(d) as
amended, and the Subdivision Requlatjons of Garfield County, Colorado,
adopted January 2, 1979, sections 2.02.21 (d) and 3.02.0.l for the
djvision of a 40.0 acre tract into three (3) tracts of apnroximately
.l3.3 acres each more or 1ess, and said 40 acre tract is more
particularly described as follows:
The SE%NE% of Section 25, T.75, R.g8l,l. of the 6th p.M. inthe State of Colorado and County of Garfield
lrlHEREAS, the Petitioners have demonstrated to the satisfaction
of the Board of county comm'issioners of Garfield count.y, co]orado,
that they desire said exemption for the purpose of resale of said
tracts into sinqle-family residential acreaqe.
I'IHEREAS , the Peti tioners have demonstrated to the sati sfaction
of the Board of county commissioners of Garfjeld county, colorado,
that there is a reasonable probability of locatins domestic water on
each of said tracts, that there is adequate.ingress and eqress to
said tracts, that the location of septic tanks will be nermitted b.v
the colorado Department of Health, that the requested division is in
accordance with the general purposes and intent of the suhdivision
Requlations of the state of colorado and the county of Garfield, and
should, therefore, be exempted from the definition of the terms
"subdiv'ision" and "subd'ivided land,, as set forth in C.R.S. .l973,
30-28-l0l (10) (a)-(d) as amencted;
N0l^1, THEREF0RE, upon the motion of Larr.y Verasquez, seconded
by Richard c. Jo11ey, and carried, said 40.0 acre tract of land is
hereby exempted from such defin'itions and sajd tract may be clivided
into three (3) tracts of .I3.3 acres each, more or less, all as is
more fully described above, and said divided tract may be conveyed
in the form of such smaller tracts without further compliance with

the aforesaid subdivision statutes and requlations; provided, however,
that said exemption is conditioned on the petitioners obtaining a
proper 1ega1 description of said tracts prior to any conveyance thereof.
A copy of the instrument or instruments of conveyance when recorded
shall be filed with this Resolution.
