Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on Tuesday , the 3rd of January A.D. 19 95 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 95--001
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE
GARFIELD COUNTY SUBDIVISION REGULATIONS FOR ROCK LEONARD.
WHEREAS, ROCK LEONARD petitioned the Board of County Commissioners of Garfield
County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided
land" under C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted April 23,1984, Section 8:00 through 8:60 and for the division of
a 10.06 acre tract as described in Book 432, Page 448, as filed in the Offices of the Clerk and Recorder
of Garfield County, Colorado, into two (2) parcels of approximately 5.03 and 5.03 acres in size, more
or less, with the exemption parcels more practically as follows:
Lot 1 (See Attached)
Lot 2 (See Attached)
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall within the
purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason
that the division does not warrant further subdivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating
domestic water on each of said parcels, that there is existing ingress and egress to said parcels, that the
location of septic tanks will be permitted by the Colorado Department of Health, that the requested
division is not part of an existing or larger development and does not fall within the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and
should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land"

as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; and

NOW THEREFORE, BE IT RESOLVED that the division of the above described 10.06 acre
tract into parcels 1 and 2 is hereby exempted from such definitions and may be conveyed in the form
of such parcels "Lot 1" and Lot 2", as is more fully described above and that a copy of the instrument
or instruments of conveyance when recorded shall be filed with this Resolution.

A tract of land situated in the NW1/4 NW'/. of Section 27, Township 7 South, Range 88
West of the 6th Principal Meridian, being more particularly described as follows:
Beginning at a point on the West line of said Section 27 whence a brass cap found in
place and properly marked for the Northwest Corner of said Section 27 bears N
00 ° 06'54" W 513.59 feet; thence S 73 ° 19'56" E 825.94 feet to a point on the Westerly
right-of-way line of County Road No. 107 as built and in place; thence S 31 °41'54" W
85.64 feet along said Westerly right-of-way line; thence S 34°34'14" W 177.39 feet along
said right-of-way line; thence N 81 °12'13" W 652.55 feet to a point on the West Tine of
said Section 27; thence N 00°06'54" W 356.04 feet along said section line to the point of

Beginning at a point on the Westerly boundary line of said Section 27 whence a brass
cap found in place and properly marked for the Northwest Corner of said Section 27
bears N 00°06'54" W 869.63 feet; thence S 81.12'13" E 652.55 feet to a point on the
Westerly right-of-way line of Garfield County Road No. 107 as built and in place; thence
S 34°34'14" W 197.50 feet along said right-of-way line; thence 90.86 feet along the arc
of a 326.01 radius curve to the left on said right-of-way line, which arc subtends a chord
of S 26 ° 35'09" W 90.57 feet; thence S 18 ° 36'04" W 66.09 feet along said right-of-way line;
thence 46.69 feet along the arc of a 322.16 foot radius curve to the right on said right-of-
way line, which arc subtends a chord bearing S 22°45'11" W 46.65 feet; thence West
4 Sz.24 `eet to a point on the West line of Section 27, Township 7 South, Range 88 West
of the 6th Principal Meridian; thence N 00°06'54" W 449.07 feet along said section line
to the point of beginning, containing 5.03 acres more or less.

boundary line of the tract of land described in Book 432 at Page 448 in the Records of
the Garfield County Clerk and Recorder whence the Northwest Corner of said Section 27
bears N 42°38'18" W 963.30 feet; thence N 63°24'13" E 100.06 feet; thence 99.41 feet
along a curve to the left having a radius of 372.56 feet and a chord that bears N
55° 45'36"- E 99:tt feet;- thence- N 48 '58" E 180.33 fe.8J_ to- the- centerline of County
Road No. 107.
