WHEREAS, W. E. LIIIBACH and GENEVIEVE LIMBACH have
requested the Board of County Commissioners of Garlield
County, Colcrado, for an exemption under 1973 C.R.S. 38-28-
101 and the Garfield County Subdivi-sion Regulations for the
\partition of a-?8 ge*e tract more fu11y described in said
request, into two tracts each of which will be less than 35
acres in area; the tracts described as:

WHEREAS, the Petitioners have shown to the satisfaction
of the Board of County Commissioners, Garfield County,
Colorado, that they desire said exemption for the purpose of
esale into single family agriculture residential acreaEle,
and
WHEREAS, the Petitioners have demonstrated to the
satisfaction of the Board that there is a reasonable probability
of locating dornestic water on each tract; that there is
adequate access to the tracts via county road; that sevlage
disposal systems to be constructed will comply with State of
Colorado and Garfield County standards; and that the requested
partition is in accord with the general purposes and intent
of the Subdivision Laws rcf the State of Colorado and presents
l',no problem related to the intensive uselland or provisions
of rrtilities and services and is not part of an existing or
potential larger land development project and should, therefore
be exempted f::om the definition of the terms "subdivision"
and "subdivided land" as set forth in L973 C.R.S. 38-28-101
and the Garfield County Subdivision Regulations.
N0W, THER-EFORE, upon motion of
seconded by and unanimously carried,
the partition of the subj ect property into tv,ro Lracts described
as Parcels A and B, is hereby exempted from such definitions
and said property may be partitioned into a tract of 23.57
acres, more or less, clescribed as parcel A and a tract of
land containing 4.L45 acres, aore or 1ess, described as
Parcel B; provided that any sewage disposal system to be
installed on the tracts shaIl comply with the State and
County Sanitary regulations and be approved by the County
Sanitarian. A copy of the instrument or instruments of
conveyance when recorded, shall be filed with this resolution"
