RESOLUTION 4. 76 -51q
WHEREAS, Ms. Esma F. Lewis has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S.
(1973) Section 30-28-101 (10) (a)-(d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted September 1, 1972 and
amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division
of a 51.95 acre trait into three (3) tracts of 3.75, 9.cn, and 445.00 acres
more or less, and said 51.25 acre tract is more particularly described
as follows:
The E 2 N Z NE1 , the NW' NE 4, N 2 E1 5 2, the NE 4 NWq NE1 all
in the North 40 acres of Lot 2, Section 4, Township 6 South,
Range 92 West of the 6th P.M.
WHEREAS, the Petitioner has deomonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that she desires
said exemption to keep her residence, sell a 2.50 acre tract to an adjoining
landowner for addition to his parcel and sell the remaining acreage; and,
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado that the existing residential
dwelling is served by individual water and sewage systems, that there is
resonable probability of locating domestic water and septic tanks on the forty-
five (45) acre tract, that the creation of the 2.50 acre tract is for the
purpose of adding to an existing hayfield of an ajoining landwoner and will
not result in any third party ownership, that the requested division is in
accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield, and should, therefore,
be exempted from the definition of the terms "subdivision" and "subdivided
land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a)-(d) as
amended; and,
NOW THEREFORE, upon motion of 42wexA. , seconded by
"R.0 Jot lel and carried, said 51.25 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by
division into three (3) tracts of 3.75, 2.5, and 45 acres, more or less,
all as is more fully described in the Petition pertaining hereto, and
further that said exemption is conditioned upon said 2.5 acres being added
to an adjoining tract of land and will not result in any third party ownership
and further that a proper legal description will be prepared for said tracts
prior to their conveyance. A copy of the instruments of conveyance when
