HomeMy WebLinkAbout3.0 Director DeterminationGarfteld County July 27,2015 Malcolm Ross and Theresa Marie Terry 1510 Forest Service 300 Road Glenwood Springs, CO 81601 DIRECTOR DETERMINATION - Lorenston Exemption Plat Amendment - Amended Final Plat (File No. FEXA -8335) Dear Mr. and Mrs. Terry, Ihis letter is provided to you, as the authorized representative for Garfietd County File FEXA-8335, pertaining to an Amended Plat to adjust the lot lines between the existing "3 Acre Parcel" and "Fathering Parcel" of the Lorentson Exemption. This letter is notification that your request to amend the final plat of the Lorentson Exemption has been reviewedby the Community Development Department and the Director hereby issues adetermination conditionally approving the request. The conditions of appioval are as follows: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specificalty amended or modified by the conditions contained herein. 2. The Plat shall be subject to final review and approvat by County Staff prior tosubmittal of the Mylar plat for final execution, BOCC signatuie and iecording (See Condition #3). All standard plat certificates and signature blocks shall be includedbn the final plat. The following amendments shail be maJe to the plat: a. A Lienholder Certificate in a form as prescribed by the County shall be added to the Plat; b. The Plat shall be black and white only. No color shall be used on the plat; c. The Name and Address of the property owners and any identified mineral wners for each of the parcels shall be identified on the plat; I d. The Plat Notes related to the vacation of easements shall be removed from the plat; e. The "3 Acre Parcel" (aka "5 Acre Parcel") and the "Fathering Parcel" shall be renamed to be numbered consecutively. ln addition, the dimensions of all lots shall be shown to 2 decimal places; f. The area of each of the parcels before and after the amendment shall be identified on the plat; g. A legal description of both of the new amended parcels shall be shown on the plat. 3. The Applicant has 90 days within which to satisfy conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any mortgagees; b. Recording Fees Notice of this decision will be provided to the Board of County Commissioners who has the ability to 'call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period (August 6,2015).
