PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and
3.02.01, the undersigned L -P GAS AND APPLIANCErCO_
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution Tracts 1, 2, 3, 4 and 5, each
containing a minimum of five acres, and all being a part of a
3,000 acre (more or less) ranch
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below:
Tracts 1 - 4 are contiguous tracts lying in a non -tillable area
previously set aside in the total ranch for the location of residences,
all being adjacent to roads and existing utilities in cluding a proven
pource of water. This water is the B -R Hopkins spring, adjudicated for
.11 c.f.s, which is approximately 50 gpm, which has been in use for domestic
purposes since 1930,
Tract 5 is an isolated tract for any useful purpose to the ranch,
unsuitable for farming due to size and being separated off by existing
county roads.

DESCRIPTION OF TRACTS PETITIONED FOR EXEMPTION:
The five tracts, for which PETITION FOR EXEMPTION is herewith
submitted, lie within the boundaries of the former Raymond Hopkins ranch
located in Spring Valley. The total rallia contains approximately 3,000 acres,
and lies totally in Township 6 S., R. 88W., 6th P.M.
A vicinity map of the ranch is attached showing the ranch bound-
aries and the locations on the ranch of the five tracts. An additional map
is attached showing,in detail Tracts 1 - 4.
TRACT 1:
5.0 acres surrounding the existing former Ray Hopkins residence
with all utilities and road in place.
TRACT 2
9.82 acres contiguous to Tract 1, served by existing roadway,
power and phone, plus 1/10 share (5 gpm) in B -R Hopkins spring.
TRACT 3:
5.0 acres contiguous to Tract 2, served by existing road with
power and phone available, plus 1/10 share in B -R Hopkins spring.
TRACT 4:
Minimum five to seven acre tract, contiguous to Tract 1, served by
existing roads with power and phone available, plus 1/10 share in
B -R Hopkins spring.
TRACT 5:
Minimum five acre tract of irregular shape lying in Sects 33 and 34,
bounded on the north by county roads 114 and 115, and on the south
by the southerly boundary of the ranch. It is served by county road
115, power is close by, and the water source would be domestic well.
