RESOLUTION #77-82
WHEREAS, L -P GAS AND APPLIANCE COMPANY, (Lyle W. Beattie, V.P.) has petitioned
the Board of County Commissioners of Garfield County, Colorado, for an exemption
under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972
and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division
of a 3,139 acre tract of land into five tracts of 5, 9.5, 5, 6.18, and 3113.32 acres,
more or less, all as is more particularly described on attached Exhibit "A" attached
hereto.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and intent
of the Subdivision Regulations of the State of Colorado and the County of Garfield
and should, therefore, be exempted from the definition of the terms "subdivision"
and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) -
(d) as amended;
NOW THEREFORE, upon motion of Larry Velasquez
Flaven Cerise and carried, said 3139 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by division
into 5 tracts of 5, 9.5, 5, 6.18, & 3113.32acres, more or less, all as is more
fully described on Exhibit "A" attached hereto, and further that no further
exemptions will be granted for said tracts of 5, 5, 6.18, and 9.5 acres. A copy of
the instrument(s) of conveyance when recorded shall be filed with this Resolution.

THIS DEED, made this 19th day of April, 1977, between
HOPKINS RANCH, LTD., a Co -Partnership; PETER M. CABRINHA, a married
man and JACQUELINE L. CABRINHA, his wife; ROBERT PECKHAM, a married
man and KATHLEEN PECKHAM, his wife and ERIC C. GROSWOLD, a single man,
of the County of Garfield and State of Colorado, of the first part,
and L -P GAS AND APPLIANCE CO., a corporation organized and existing
under and by virtue of the laws of the State of Colorado, 207 10th,
Glenwood Springs, Colorado, of the second part:

There is also hereby conveyed, by spacial warranty and not by deed
