The source and amount of water supply is daailed in a letter provided by attorney
Roben Noone, who has applied otr our behalf to the Colorado Vater Conservation
Board for three well permits.
Engineering was accomplished by Paul Busone of Resource Engineering.

TOPOGRAPHY;

The impaa of this subdivision on the lakes, streams and topography of the parcel will
be signifi cantly p ositive.
Ve have applied to enroll the property in the I7HIP $fildlife Habitat Incentives
Program) ii-i.ristered by the Naiural Resources Conservation Service, and we have
applied for a permit from the U.S. Army Coqps of Engineers to begin a stream
r.io*,*ction and stabilization projea. That permit has been granted.
As pan of the long-term plan for the property, several obiectives have been slated that
wili enhance the tofu, *ildlands and stream course found on the ProPerty:
1. Stabilize ttre stream to provide trout habitat;
2. Plant cottonwoods along the stream banks to begin root growthand
promote stream stabilization, as well as roosting and nesting habitat for
raPtors;
3. Plant serviceberry, chokecherry, gambel's oak and netive grasses in 2Gfoot-
wide wildlife zores for songbird and s-all -em-al habitat;
+. Dredge sragnam pond and provide water flovr to provide-habitat for native
(and indangeredf greenback cutthroat trout to be stocked;
5. Fence stream banLs to keep livestock from degrading waterways;
6. Rotate grlu;iryto Prevent erosion.
The overall effea on stream courses, watercrays, ponds, and topography should be
very beneficid.
SETBACKS: One homesite is tentatively plan''ed for the tronhern boundary of the

propeny, set back approximately 40 feet-fiom the river's high-water y"+. This site is
not in any floodplri", ,r it is some 30 feet in elevation above the creek. No other
buildings'are plannedin any floodplain, and other buildingp yn !q at least 100 feet
from th-e.r.Jk. At no timi will any buildings be constructed within the 3O-foot
saback from the creek.

ELECTRICITY: A Public Service rnain power line borders the west edge of the
propeny. An application h'as been made to Public Service for electrical service.
NATURAL GAS: There is no natural gas service to the site. Gas will be provided by
propaoe service trucks. Much of our heat will be provided by catalytic wood $ove
and by passive and active solar design
TELEPHONE: A new fiber-optic line was instdled by US \flest a few years ago atld
borden the properry on the west boundrty. Ao application has been made to US
Iflest for service.
CABLE TV: There is no cable TV service to the ProPeny. Television will be
provided by 18" satellite dishes.

There is no doubt that building additional residences in a rural area will have an

have a positive effect on the local wildlife.
However, we are attempting to create an envirott-ent as friendly to wildlife.as

AGRICULTURE: The Hubbell family subdivision is very compatible with
agriculture. Nothing in this development could be seen as inhiJiting farms and
rtches from operatLg normally. ih. density is extremely low, and the maiority of
our acreage *ill b. k.pt i" agricultural production. Housing sites arg located in areas
of lowest agriculftnl prod,r&irrity, and ditches and fences will be mai''tained to
ercourage [ood agricultural production. Dop will be contained on the propeny and
kenneled while owtrers $e ewty.
HOUSING: lfhile the planned residences will be custom homes, they will provide
horsing forthe owners of the propefty, who are 35-ye* county residents. This is not
a subdivision for resale to out-of-tow'n owners.
There are currently no buildings on the propertli, and there is nothing of
historical significence on the property. There are no adiacent indrstrial rsa.
Ife are planningto build homes of high energy efficiency rsing both passive
and active solar design, with alternative energy-efficient materials such as adobe or
perhaps even straw bale.
RECREATION/OPEN SPACE: The development will preserve at least 80o/o of its
area as open space. Recreational opportunities will increase through -li..T.q Colorado
outfitteiGary Hubbell, who offers hyfisH"g and hunting gtude services in the westertr
United States.
I7ATER/SESIER: The parcel has adequate agricultural water right". 'We-have
applied forthree well permits and haveiubmitted a water augmetrtation plan to the
Colorado River'Water Corservanry District.
The soils will be tested by HP Geotech and a suitable septic/leach field sewage
disposd sysrem will be engineered for each horse on the site. No central waterAewer
system exists in the area.
TRANSPORTATION: This development will create minimal additiond impact on
the roads in this area. No excessive road cuts are necessary to build access roads.
Rgnoffwill not increase by excess pavhg. In fact, with additional plantinp and
fencing, runoff should be further stabilized as a result of this development.

RELATIONSHIP TO COMPREI-IENSIVE PLAN (P.2)

to 6e site, with the posible exception of slow-perc sofu, for which leach fields will be

Vegetation ani wildtife habitat will not only be protected, it will be enhanced

COMMUNITY SERVICES: Impact upon community services will be small. Fire

An undivided 38% interest in and to that real property described on Exhibit "A"
attached hereto and incorporate&,.herein by this reference being that real property
conveyed and described in Deed recorded book 927 at Page 292 as Reception No.
472882 of the records of the Clerk and Recorder of Garfield County, Colorado;
Together with any and all water rights, ditch rights, easements and rights-of-way
appurtenant to the above-described property;
together with all its appurtenances, and warrant the title to the same against all persons claiming
under the Grantors, except and subject to that certain deed of trust dated January 4, 1995 and

At your request, we have investigated the potential for providing a water supply for three single
family homes, one guest house and up to ten head of livestock on Lot 3 of the Ri$oli Subdivision' consisting
of approximately 24.76 acres in Garfield County'
In conjunction with Resource Engineering, lnc., we have determined that both a legal and physical
water supply can be developed on the indicated p--p.try for the proposed uses and have recently filed an
application in Water Division 5 to adjudicate the necessary water rights.
I enclose for your review a copy of the Application for Groundwater Rights, Surface Water Rights'
Storage Water Rights and Plan for Augmentation which was filed on December 10' 1997'
After you have reviewed the urclosed, please contact me with any questions or comments you might
have. I will keep you apprised of all matters as the Application is processed through water court'
