PETITION FOR EXEMPTION
Pursuant to C.R.S. L973, 30-28-101(10) (d) and the Sub-
division Regulations of Garfield County, Colorado, adopted
1 September, L972, Sections L.02.17(d) and 3.02.01, the under-
signed, PauI E. Lappala and Virginia Lappala, respectfully
petition the Board of County Commissioners of Garfield County
to exempt by resolution one certain parcel of land, more fulIy
hereinafter described, from the definitions of "subdivision"
and "subdivided land" as those terms are used and defined in
C.R.S. L973, 30-28-101(10) (d) and the Garfield County Subdivision
Regulatiol", for the reasons set forth beIow.
1. Petitioners are the owners of the following described
property, to-wit:
A tract of land in the W l/2 NW I/4 of Section 27,
Township 7 South, Range 88 West, 6th P.M. describedas follows:
Beginning at a point which is the stone quarter corner
common to Sections 27 and 28, thence along the sectionline N. 00"06'54" W. 2139.30 feet; thence S. 73o19'55"E. L362.49 feet to the East side line of the W L/2 NW 1/4,Section 27i thence S. 00o05'23" E. 1788.97 feet; thenceN. 88013r21" W. 1304.37 feet, more or less, to the pointof beginning, containing 5g.022 acres, more or 1ess, inGarfield County, Colorado, which is zoned agriculturaL/
resident iaL/rura1 density.
2. The petitioners desire to exempt therefrom in order
to convey a tract of land described as follows:
A tract of land contained in the NW l/4 NW l/4 of Section27, Township 7 South, Range 88 West of the 6th p.M.,
more particularly described as follows:
Beginning at a point on the West line of said Section27 whence the Northwest corner of said Section 27 bearsN. 00o06r54" W. 513.59 feet; thence S. 73o19r56" E.825.94 feet to a point on the Westerly right of way ofthe County Road; thence S. 31041'54" W. 85.64 feet alongthe Westerly right of way of the County Road; thenceS. 34034'14" W. 374.89 feet along said right of way;thence along the arc of a curve to the left on saidright of way, which arc subtends a chord of S. 26o35t09u
W. 90.57 feet; thence S. 18036r04" W. 66.09 feet alongsaid right of way; thence along the arc of a curye tothe right on said right of way, which arc subtends achord bearing S. 25026'29" W. 47.64 feet to a pointon said Westerly right of way of the County Road;
thence West 449.82 feet to a point on the West lineof Section 27, Township 7 South, Range 88 West of the6th P.M.; thence N. 00006r54" W. 805.11 feet along said

Section line to the point of beginning, containing 10.058
acres, more or 1ess.
Attached hereto are copies of a portion of a U.S.G.S. Topo-
graphical chart showing the subject property.
3. The tract is unimproved and is contiguous to an existing
60 foot roadway easement crossing the northerly portion of
said tract and on the sale of said tract the purchasers will
be granted a non-exclusive roadway easement so that the tract
will have access to the adjacent County Road.
4. A power line is located so as to provide electric
service to the tract sought to be exempted.
5. There is no domestic water presently on the property,
however, other homes in the area are served by weIls. It is
contemplated that the purchaser of this property will drill
a well and will thereby obtain a suitable supply of potable
domestic water.
6. There are no sanitation facilities presently located
on the tract sought to be exempted., however, a purchaser will
be required to comply with all applicable rules of Garfield
County Sanitation Office and the Colorado Department of Health.
There is no reason why the Department of Health should not
permit or approve an appropriate septic system to be installed
on the tract.
7. Copies of the deed of conveyance of the tract will
be filed with this Petition and the resolution if the exemption
is granted.
