Dear Mr. Farrar:
We have reviewed the material submitted for the above referenced
minor subdivision. The developer proposes to use wells for the water
supply. These wells would lntercept ground water which is tributary to
the Colorado River at a point where there is still water available for appro-
priation. This office can issue individual domestic well permits to
individual lot purchasers and we recommend approval of the Lemon Ivllnor
Subdivision.

location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and intent
of the Subdivision Regulations of the State of Co1orado and the County of Garfield
and should, therefore, be exempted from the definition of the terms "subdivision"
and ,,subdivided land" as set forth in C.R.S. (1973) Section 30-28-l0l (f0) (a) -
(d) as amended;
WHEREAS, the Petitioners have shown to the satisfaction of the Board of County
Conmissioners of Garfield County, Colorado, that the I .22 acre tract and 2.7 acre
tract of land will be conveyed to adjoining landowners for addition onto existing
lots of record and wi]l not create any third-party ownerships;

exempted from such definition and transfer of said tract may be made by
division into 6 tracts of 8.74, 8.74, 6.0, 2.7, 1.22 and 22.6 acres, more or less,
aIl as is more fully described above, and further that a proper lega1 description
be prepared before conveyance of said tracts, and further that said I.22 and
2.7 acre tracts of land are to be sold to adjoining landowners for addition to
existing'lots of record and will not create any third-party ownership. A copy of
the instrument(s) of conveyance when recorded shall be filed with this Resolution.
