PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Request for a S.B.35 exemption
APPLICANT: Clarence & Lessie Lyons
LOCATION: Section 30, T7S, R87W; one mile
north of Catherine's store off
County Road 100.
SEWER: Septic
WATER: Proposed water tap to be connected
to the Lyons Ridge Subdivision.
ACCESS: Existing (off County Road 100)
ZONING: A/R/RD
ADJACENT ZONING: A/R/RD
I. COMPREHENSIVE PLAN
The site falls within Districts D & F of the comprehensive plan.
These are rural areas with moderate and severe environmental
constraints. The site is within one mile of an urban area of in-
fluence. The comprehensive plan states that Districts D & F
within one mile of an urban area of influence shall be considered
a transition zone with a density of no greater than one dwelling
unit per two acres.
II. PROJECT DESCRIPTION
A. Site_Description
The site is hilly and has poor topsoil conditions. There is
currently a mobile home on the 5 acre parcel.
B. Description of the Proposal
On October 19, 1981, the applicants requested a Mobile Home
Special Use Permit for a 5 acre parcel. This request was
approved, however, on October 26, 1981, the approval was
rescinded because it was found that the 5 acre parcel had
never gone through the exemption process or through
subdivision review.
The applicants owned a large tract of land of which
they sold a part of to Al Storey for the Lions Ridge Estates
subdivision. They also sold part of it to Harold and Marianne
Lyons and to Marion and Ann Samuelson. When these parcels
were sold in 1979, the applicants were left with a 5 acre
parcel. It is the request of the applicants at this time to
go through the exemption process so that the 5 acre parcel can
become a legally created parcel.
III. MAJOR ISSUES AND CONCERNS
1 There is currently a mobile home on the 5 acre site. This
mobile home is not permitted for occupancy. If it is being
or is intended to be occupied, the applicants must apply for a
Mobile Home Special Use Permit.
2 The applicants have a signed agreement to install a water tap
and have water provided by the Lyons Ridge subdivision.
3 An access easement to the parcel should be noted on a plat
with the legal description of the 5 acre parcel and recorded
in the Clerk and Recorders office.
4. The applicants were issued a septic permit on October 23 of
1981 by the Environmental Health office.

IV. FINDINGS
1. The proposal is in order with the acreage requirements for the
A/R/RD zone district.
2. That for the above stated and other reasons, the proposed
zoning is in the best interest of the health, safety, morals,
convenience, order, prosperity, and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
Approval of the S.B.35 exemption with the following
,conditions:
That an access easement be created for the 5 acre parcel
and that this easement shall be noted on a plat showing
the 5 acre parcel. This plat shall be recorded in the
Clerk and Recorders office and shall reference the
resolution of approval creating the 5 acre parcel.
2. That prior to occupancy of the mobile home located on the
property, the applicants must apply for and obtain
approval of a Mobile Home Special Use Permit from Garfield
County.
3. That $200 shall be submitted to the Department of
PPPP Development for the school impact fee.
